Rise and shine, fever dreamers. Look alive, my friends. I'm V Spear. And I'm Sammy Sage. And this is American Fever Dream presented by Betches News. Where we explore the absurdities and oddities of our uniquely American experience. Speaking of odd and absurd, we've got an urgent issue to address. So we're going to start the show with an interview and then get into the regular episode. Today, we've got friend of the pod, A.B. Burns Tucker on the show. You may know her better as at I Am Legally Hype on all the social media channels.

Her brother, Brandon Parks Burns, is being unfairly detained in a San Bernardino prison. Brandon's story has taken social media by storm as an example of the wildly unfair incarceration system and its disproportionate effect on Black men. A.B., thank you for making the time for us today. Thank you so much for having me. I appreciate it. Yeah. So you're in it. You've been in it for a while now, trying to get your brother out of prison.

Run us down the resume that you ran down for Governor Newsom when you dressed him down this morning. Yeah, for sure. So, okay, so boom. I had to let it be known. Like I have two bachelor's degrees, right? One in political science, one in criminal justice. And I actually changed my major to criminal justice when Brandon was first arrested. I have a master's degree in criminology law and society. And then I have a law degree with an emphasis on criminal law. And I also had to let it be known, I aced prison law.

And if anyone has been in law school, getting an A plus in law school is not an easy feat. In addition to that, I have worked for organizations such as the ACLU, Project for the Innocents. I also interned at the Los Angeles County DA's office. I have worked as a judicial assistant at Los Angeles County Superior Court.

I've done it all. I am on the board of directors for a post-conviction nonprofit organization called California Innocence Advocates. So this is what I do, right? I advocate for those who are incarcerated and I push for changes in our criminal justice system and for prison reform. Tell us from the beginning, just quickly to catch folks up.

Why was Brandon arrested? What happened at the root of this issue? Yeah, so this is a crime that occurred when Brandon was 15 years old. And essentially, this happened in San Bernardino County, California. He was arrested based on the word of a police informant. And this is an informant who has testified in multiple cases in San Bernardino County. At one point, I did research on the prior cases where he had

and there were convictions. And if you add up all the convictions that he is responsible for, it adds up to about 300 years in prison that we have Black men spending in our California system right now. And what I saw in doing my own research is oftentimes it was for him to free himself of a crime that he had committed, right? And he made some sort of deal or had an arrangement with

the DA's office or whomever was in charge to make the deal, to say it that way. And it worked time and time again. So what essentially happened is Brandon was accused of participating in a murder with another young man. There were witnesses who said, actually, Brandon wasn't the person that was there. Prior to trial, the co-defendant also said, Brandon wasn't the person who was with me when this happened. However, the district attorney had that statement thrown out as hearsay.

because it is an out-of-court statement that would have been used to prove the truth of the matter. But if that person does not testify, it is therefore hearsay. When you are a defendant in a criminal case, you have the Fifth Amendment right to not testify. They were tried together. So obviously, you know, he wasn't going to testify because that could have harmed his chances of

And so basically this informant said, you know, yeah, Brandon and, you know, the other gentleman went and committed this random murder in this neighborhood. There's no evidence to prove that Brandon was there. The evidence that they tried to use was saying that Brandon had a shotgun at the scene. There were shotgun waddings found at the scene, but those waddings were found to have been old and had been there for quite some time before this event even occurred.

They also tried to say that Brandon and his co-defendant jumped over like a six foot wall. Right. Brandon's 15 years old at the time. Brandon had just came off an injury like a football injury. So it's very unlikely that my brother was able to hop a six foot wall with a shotgun that he's never used.

Never trained to shoot, never had in his possession. However, the informant, his father came to court and testified and said, my son had that shotgun at my house. Lo and behold, detectives never found the shotgun, right? It's our understanding that the informant sold the shotgun. And so they were never able to find it.

Also, the informant changed his story multiple times about what happened. At one point saying that Brandon drove the car to go pick up the weapons and drove back. Again, Brandon was 15 years old. He hadn't had any training driving, right? He had never driven a car before. So that was pretty much impossible as well. However, you know, they got crafty with their story. What ended up happening is Brandon,

right before the end of trial, maybe like a week or so before the end of the second trial, because we went to trial twice. So the first trial was a hung jury. They retried the case. And the second trial, the co-defendant took a deal for voluntary manslaughter and received six years in prison. Brandon finished trial by himself. The judge doesn't tell the jury why the co-defendant's not there.

So the last, I think, week or two of trial, Brandon was tried on his own. So now you see this young boy who's now 18 years old, has been incarcerated for three years, looks like a grown man now, right? Not the child, right? That would have been present at the scene had that been true. But a grown man, you finish trial by yourself. And essentially, he ended up being convicted.

The jury deliberated for maybe four or five days. He was convicted and sentenced to 50 years to life in prison, which in California is a life sentence. You are just eligible for parole after the 50 years.

Wow. And he decided to finish by himself and not take the deal because he wasn't guilty. So he thought, well, I'm going to be able to prove I'm innocent. All these people are saying I wasn't there. I didn't own the gun. I wasn't there. Why would I take a deal when I didn't do it? And then this is what happens to him here.

So you've been coming at this both as a family member and an advocate and a very trained lawyer. So I guess from three angles. So what did you do to eventually clear his name and what finally worked to get him back?

eligible for release? So a crazy thing is I work this from every which angle that I possibly could, right? Like it's probably easier to say what I didn't do than as what I did. But to get us to this point, what ended up happening is while I was in law school, I actually received a scholarship while I was in school. And I was telling the donors like my story and they said, well, we're going to help you pay for counsel.

And in addition to that, that sort of started like kind of getting ears ringing on campus. And it just so happened that a professor at my school, her brother was a public defender in San Bernardino County at the San Bernardino County Public Defender's Office.

And so simultaneously, I was able to find counsel for Brandon, post-conviction counsel, and then also was working simultaneous with the public defender's office. So we were kind of attacking his case at several different angles.

On the one angle, you're attacking like, well, he's not the primary person who committed the crime. Right. And so California laws had changed with regard to that. But also in the process, California law was changing with regards to sentencing juveniles as adults.

And so we were kind of failing on the track of saying like, well, he wasn't the principal and so he should have release. And the Supreme Court came back with a case in California that Brandon was eligible for. So basically in California now, if you were convicted of a crime and you were 16 years of age or younger, then you are no longer to be automatically tried as an adult.

And Brandon was automatically tried as an adult. There was no juvenile hearing or Franklin hearing, as we call it now, to test his competency or anything like that. He went straight to adult court, which is very common for black males in San Bernardino County. And so based on that, the public defender was able to get Brandon resentenced. So his case was actually moved down to juvenile court.

And then so the juvenile court was able to hear and resentence him based on juvenile laws. And so essentially he received time served and was scheduled to be released on his 33rd birthday, which was September 13th of this year.

That's what's on paper for what she did. I'm going to tell you, I've been in the room with A.B. many times. The very first time we got invited to the White House, like as little influencers, what did we do? We staged a moment for her to be able to tell the president about her brother. And he looked at it like, and what did he say? He said something back to us like, well, that's what clemency was for. And we're like, okay, go do it. He didn't. No, you know what he said? He goes, well, I pardoned people who did commit the crime. And me and you are looking like, well, bro, do you need a pen? We were like, come on then.

That was crazy. And then that was a couple of years ago. And then you've been able to speak to Governor Newsom since then. And this has just been something that we have continued to bring up to people. And they have promised us, you know, oh, we're going to look into it. We're going to look into it. Seems like it should be easy. He eventually did get the release. He was supposed to be released on September 13th. I was making the T-shirts. I was ready to come and party in California with Brandon. He wrote a letter on his behalf.

I did write a letter on his behalf as a character witness for him. And now it's October 15th, as people are going to be listening to this. It'll be October 15th. Why is he still in prison? We don't know. Why are they saying he's still in prison? They don't know. So the only thing is that because of how he has been resentenced and reclassified, he is under the jurisdiction of California Department of Corrections.

So, therefore, the institution where he's being held, which is R.J. Donovan in San Diego, California, they have to release their hold over him to allow him to be released back into society, essentially. So once the judge put in the order and what I found was like, okay, well, they had 30 days. They had up to 30 days to process that release so that he could be released to his family. Time's up, right? Right.

Is there any communication that they are giving to you that contains an explanation or a timeline that you can expect for him to be out? So the last we heard is that CDCR, RJ Donovan was contacted and like, you know, what's the holdup, what's going on? And the response from them was we have 30 days, right? Like we have a month.

And so it's really just a breakdown in communication. Right. And it sounds like this could be administrative, but that's a problem to me because the reality is that like I am blessed to have a platform and to also have the legal knowledge to know y'all are wrong.

And this is not acceptable. But it makes me wonder how many other families, right, who have been granted this level of release or have gone through this process, who perhaps are still waiting for their loved one to be released and don't have any information or don't have the ability to ask questions or get the resources to make sure that their release is proper.

In addition to that, it's a safety issue now, right? Because Brandon was supposed to be released months ago. The worst thing you can do in prison is be someone who is going to be released because for whatever reason that triggers things in other inmates. And I've seen this, right? And the research is because, you know, that starts problems, right? And then you get antsy as an inmate. Like I spent 60 days in jail, right?

when you're coming up to your TV show, 60 days in for the TV show, 60 days in, she did a, she wanted to see what it was like from the inside to learn the whole thing. Yeah. I wanted to see what it was like from the inside. And one thing I observed is as soon as you get close to that release date, you're,

Inmates start like something triggers in them and they start acting erratically. Right. They're very irrational. They're very antsy. Their mood switches. And then, you know, you've got other inmates who know they're not going home no time soon. They start hating and they may want to start an altercation with you or get you riled up or get you to do something that may perhaps get you more time.

in there, right? So that's another reason why it's like y'all need to move because not only legally is he released and needs to come home, but now you're putting his safety at issue. And we've already fought with y'all for 17 years. Like this is not fair. It's insanely unjust when you think about the fact that someone like Jeffrey Epstein would never spend more than a second in jail. Right now we have the Republican nominee out on bail, actually.

It is such a double standard and just terrible that someone can just kind of, oh, they're just, oh, let's get an extra day without any regard for what they're experiencing in that time and any dangers. And also just the straight up injustice of it. Like that was not his sentence. So you are subjecting him arguably to cruel and unusual punishment. There are many arguments that you can make for how much harm this is causing. Yeah.

And he's in there with some very notorious people. I mean, Suge Knight is in this particular facility, the Menendez brothers. So, I mean, this is a high profile place in the first place. We need to get Brandon out of there right now because this is already a warden in a prison that doesn't like all the celebrity attention and all the drama and causes problems for people. So is there anything that the Fever Dreamers can do to try and help or push this along? Yeah.

Yeah. So I have actually been pushing a campaign online for Governor Gavin Newsom to push the button or call whoever needs to be called in CDCR to push the button to release him, right? Because that's as simple as it is. You have the court order. We've gone through the

process. And the reason why I've been calling on Governor Gavin Newsom is because you have jurisdiction over the Department of Corrections, right? Outside of that, our only option is the California Department of Corrections, and clearly they're not doing their job. So let's go above you and hold you accountable. You have at least two more, or I think only two more years left as governor in California. You just was parading Sam Quinton on your podcast,

right, politicking not too long ago and talking about how bad the California system is, right? California has been sued multiple times, has had an ongoing lawsuit since Governor Schwarzenegger, right, because of the conditions within the prison. And now you have someone who has been released who is now a citizen.

citizen of the United States of America and should be protected under our constitution. And so for you as governor, I'm holding you accountable to make sure that your department of justice does what it's supposed to do. And at this moment in time, it has released my brother. That's right. And his grandmother is waiting for him. You guys, his grandmother's waiting. She's got the food ready. The whole family's waiting. We've got, you know, my mama, you stole from my mama.

It was his birthday. Wasn't it his birthday in this amount of time too? It was his 33rd birthday. His grandfather actually, who lived to be, I believe 104 years old, actually passed a day or two after he

He found out Brandon was being released, right? So we believe like he was at peace with knowing he's coming home. Brandon thought he was going to get to attend the funeral at the very least, right? Like he's lost 17 years with his family. He missed the funeral because y'all are playing games as opposed to releasing him. My granny, she got oxtails waiting and she says she's not cooking them oxtails until Brandon come home. And I loves me some oxtails. I know.

I mean, this is the thing. There's a plan for Brandon when he gets released. There's work programs. There's a loving family. And this is just one of many stories, right, that we're able to put on the show today. But it's happening to so many families across this nation. So we'll put in the show notes how you can contact Governor Newsom's office and tell him, let Brandon out.

And while you're there, maybe fix the administrative issues you've got with the warden's office down there so that this doesn't continue to happen to other people. And if this is happening to anyone else or anyone else's family members who's listening, please write into AmericanFeverDream at Betches.com. Let us know. Tag all of us on social because this isn't, I'm sure that if this can happen to you, this is, I'm sure, happening or has happened to thousands of people and families.

AB, tell folks where they can find you so that we can all see the pictures when Brandon comes home. Absolutely. So you can find me on mostly all social media platforms at the handle I am legally hype. So check me out. Look me up. I am always talking about social justice issues and trying to educate the community the best way I can. And feel free to like, you know, reach out to me. Anything I can do to help. Like I am here for y'all.

because I know how hard this is, you know, and I've been going through this for a long time, again, from a lot of different angles and it's heavy. And sometimes you just need somebody to just be like, you're going to be okay. You know what I mean? Like it's hard, but you're going to be okay. And if that's what you need, you can count on me because I'm going to let you know. Yeah, it's going to work you. It's going to chin check you, but you're going to be okay. Yeah.

Well, we love you so much. And we will, again, have in the show notes how people can help get more attention for Brandon so he can get home and have those oxtails, you know? He deserves them. He deserves them. Oxtails for Brandon. Oxtails for Brandon. Thank you so much, A.B. We'll see you soon. Thank you as well.

Welcome back. Here we are, 21 days until Election Day. Time is flying. Sammy, I have some good news for you. Do you know that you can get off these frigging emails and text messages if you vote early? If you vote early, as soon as your ballot hits, they take your name off the outreach list. So for folks who were considering voting early or are mail-in voters or whatever, get your ballot in as quick as you can because it allows them to redirect their attention to people who haven't voted yet.

That is an even better incentive than an I voted sticker. Dude, for real. Well, I realized that I won't be here for when my open voting is like the last two weeks because I'm in like Mexico and then I'm in New York to do the show. And so I had to vote early. So I just got my voter early thing and I cannot wait to get it in because these emails got to stop, man. All I hear is how much money Kamala Harris has raised. And I'm like, when is it enough? When is it enough to stop asking me for five dollars?

she has raised a billion dollars. She's the first candidate to ever do so. So get yourselves off that list. But it's so funny. The fundraising emails come in. It's like, the subject is like not great. And then they show you a chart and it's like her fundraising is going down. It's like, oh, you mean from the first week where she raised record-breaking amounts of money? I know. And they got to stop putting James Carville in front of me. Like God, God help

me. The man called us preachy females in democratic politics. Stop putting them on my subject line emails. There's a lot. Look, we could get into like a full meta media critique today, but I think we've done enough of those and there's too much actual news to talk about. There is. I do have one more. Well, I have one more news, funny news thing. Speaking of media critique, friend of the pod, Cammie Crawford, the former host of the show Catfish was honored by the Advocate magazine. A queer magazine is one of the top LGBTQ news

political influencers that you need to follow this month. Now, I was number one. Oh, is that how you just got how you inserted this in here? Yes, this is how I'm making it about me. I was number one and Kami was like number nine. And then Kami calls me and she's like, I need

to tell them that I'm not gay. And I'm like, not even a little bit. And she's like, not even like a little bit. I'm like, maybe the only person who's not even a little bit gay. So Kami had to call the advocate and she was like, I don't know how you got my name. I'm so honored that you follow me. And like, I'm so grateful, but it would be really disingenuous of me to like stay on the list because I'm not queer or bi. I am unfortunately an entirely so straight, but I'm an ally. And they were like,

this is terribly embarrassing. Okay. But now I want to know who they put in because the new list came out and I didn't, I didn't like screenshot the first one because they added somebody. So I want to know who, who can be beat by one. I want to know like what made them think that about her. We're friends. I'm telling you every single woman that I encounter in my life, people think that I'm dating. Like you've, it's happened

to you when we go places and they're like, oh, is this your wife? And I'm like, no, it's Sammy, my ghost. It happens to my sister, to my mom. They just assume every woman that I'm near is my wife. So me and Kami did the podcast together and a couple other things at the DNC. And I'm wondering if they thought that Kami was queer because she was in videos with me.

That seems like a really bold assumption for a publication. I know. No offense to Advocate, who did just deem you number one. Number one. And we love the Advocate and people make mistakes and whatnot. But also, Kimmy does give strong allies. So I could see where like, you know, maybe.

she's on MTV. Who's not bisexual on MTV. Literally only Cammy. Cammy is the only straight person on MTV. Also, it would be funny if like she did sort of feel maybe she was a little gay, but like hadn't really, like hadn't really ever said it. Yeah. So it was not public. No, she could have been outed. As like, okay, you just, you out. I guess I'll take it. You know, her boyfriend thinks it's the funniest thing in the world though. He's like, Cammy, are you sure? Maybe you should consider. She's like, no, I mean,

Right. It's like, you don't have to break up with me. No hate, no shade. She's just like, I am unfortunately an entirely so straight and like, just as what it is. Maybe they were just like, you know, most people are on a spectrum. The odds are good. So anyway, I thought that was so funny for her. And it gave me like a moment of levity that I really needed in this like horrific, honestly, these last couple of weeks been brutal, man.

It is a heavy week. Okay, maybe we do stay with the media critique, but in the context of the polls, because people are, that seems to be the talk of everything. I mean, people- What's the deal? Who are political, non-political, keep talking to me about the polls. And there's a few different pieces to this, some of which are more inside than not. But that said, I don't want to downplay any sort of data.

One thing I will say is that a lot of what we're looking at are polling averages, and these averages are stuffed with

Republican-leaning polls. It also has neutral polls, but there are no Democratic-leaning polls that will counter those Republican-leaning polls. So you can look at the polling where it really does seem to be tightening in both the national average. NBC had a poll out yesterday that they were tied 48% to 48% just as a national race. But we know that the races aren't national, but it's

But in swing states, it appears to also be tightening. There's also, Alyssa Slotkin and Tammy Baldwin are also running Senate campaigns in Michigan and Wisconsin, respectively. And their internal polling reportedly from inside sources says that she is underwater in those states would be a big problem.

So there's that information going around town. Then there are other indicators that she is performing with new voters and with undecided disengaged voters better than Biden was and better than Trump is. I mean, I look at their yard signs. That's my poll. I drive around and I live in what Kathy Hochul described to us one time as the most Republican district in New York.

And there's, you know, I got a couple, I see a lot of local Republican signs for like our state and our mayor and stuff like that. And like, honestly, some of the Republicans who are running for like my little towns, things like they're my neighbor, they're decent people. It's just, they're fine. We're planning to vote for like, I don't know, our superintendent of the town or something. Alderman is a Republican and there's a little sign for him out there.

But there's no Trump sign. So I'm like, these are people who are either going to skip the presidential, maybe give Kamala a tick and not tell anybody as a way to fight MAGA. And then they're continuing in their hyper local. I'm not even talking about my state senators and stuff. We're talking about the town politics. They're going to keep that Republican.

I will say I also live in a pretty red area in Suffolk County. It is, it does vote red. The representative is a, is a Republican. And in 2022, there were so many signs in general, just everywhere. Now there are very few signs. There are two houses that have Trump signs, uh,

One of them has like a hundred dozens of signs, but that's the only one. And then you do have like, I saw a Harris wall sign. So it's like, we're literally two versus one in this. And then you do have like, like you were saying, like those local and houses that have those don't have Trump.

I never saw Trump don't have the local stuff. Correct. I never had a Biden. I never had a Biden that I can remember from the, from the even 2020 time. And I am seeing Harris wall signs this time. There's not the same enthusiasm. He also can't fill a stadium in Pennsylvania. And if you can't do that, I don't understand how you could win Pennsylvania when she can. Well, there he's doing some weird stuff. I,

Personally, and this is not for us to give up, but I think he has given up on believing that the strategy is to try and win votes anymore. I think we're long past that for him. And now it is how he's going to prove that there was corruption, how he's going to prove that it was rigged. And this tour he's doing of blue cities, going to Coachella,

Not the music festival, but the Cadillac Ranch venue where they hold Coachella in California and trying to show like, look at how big my crowds are because he's busing people in, which is something he accuses the Democrats of doing, busing people in. But he's busing all these folks in and he's trying to show that he's got all these people coming to see him in these blue cities and that there's a chance of these blue cities so that he could just claim corruption.

How could I lose when I've got all these big crowds? Well, just because those are big places. So lots of people will go. And also he doesn't have the big crowds in Pennsylvania. But here's the other thing is that if you actually look at the voter data so far,

out of Pennsylvania, it highly favors Democrats. And a lot of it is being driven by white women. So a lot of the concerns in the polling are that she's doing worse than Biden was with Latino voters, Black men,

But it seems she may be overperforming white voters and it might even be white women. I believe it. Look, imagine white women for the first time. We owe them. We owe them a good vote. Maybe that's like the last stretch what it should be because –

I really feel, I mean, if you look at all of the former Trump officials and you look at the Republicans who crossed over other than Mitt Romney and Adam Kinzinger, it's Liz Cheney, it's Sarah Matthews, it's Cassidy Hutchinson. They're the ones who are out there

putting themselves on the line against these crazy people who are forming militias to stop FEMA officials in North Carolina from doing the recovery. We'll get to that in a second. It's gone too far. They're putting themselves on the line.

Maybe that is who will ultimately overperform for Kamala Harris in this election, because there is concern that she is soft with some other groups. And, you know, there's still the question of like, what will the polling error be? Can the polls really be trusted? Look, I think they're still, I think they're full of shit. I'm going to say it. I think you and I, you know, can be rational and try to treat things as if they are real. But at

At the end of this, I always have to remind myself that Trump is full of shit and lies. His people lie. Everything that comes out of that campaign is a lie. And I also think it might be a lie that he's over-indexing with black men as a way to create more division amongst the Democrats. Be like, why aren't black men doing their part? Like it just creates more shit for us. So I don't believe him. He also said, so going back to this Coachella thing that he did, he bust like thousands of people out to the desert during a hundred degree heat and

to attend his Coachella rally. He says that 100,000 people attended. My researcher Jed says that the Calhoun Ranch maxes out at 15,000. And he was actually at the Weezer concert, which was in Palm Desert, which was, I guess, like very nearby the Trump rally. And he's like, I'm telling you, Weezer had a bigger crowd than Trump. All right. Like this was not this wasn't even the main event of this particular part of California, the Trump rally.

Also, Calhoun Ranch is not really part of – it's a private polo club. Right. It's not – there wasn't 100,000 people there. At most, there was 15,000, and he didn't max it out even with busing people in. Dennis Quaid spoke publicly.

Ruining Parent Trap for absolutely no good reason. I always like Pierce Bronson better if we're going to compare apples to apples for those guys. And then he's just becoming more and more unhinged and he's testing the boundaries of how far he can get away with fascistic things. Like there was a female heckler in the audience and he said that people should, quote, beat the hell out of her.

The last rally he was at, he said, raise your hand if you're for Kamala Harris. Oh, you better not raise your hand. It could be real trouble for you. He has said things like that he thinks there should be one big day of violence like the purge and it would fix everything. He is testing how violent people are willing to be in his defense.

He also said yesterday with Fox News, there is an enemy from within and on election day should be handled by the National Guard or the military if necessary. To take out the radical left loonies. He put a name on who it was for too. And we are so lucky he is not the president right now because if this were 2020, it would be happening. Yep.

Well, let me break that down for you. Why he said national guard first is because he believes that the red, he, he's so fucking stupid, Sammy. I, I like, I'm, I'm like losing my ability to be decent in this because I don't talk like that, but there's not another way to say it. He,

He believes that the governors control the National Guard and that these Republican storm soldier governors like DeSantis or whoever were in Georgia or Pennsylvania will like side with him and will deploy the National Guard to turn arms on civilians. One, the National Guard reports to the army. The army said, no, the fuck they're not.

And two, he said, or the military. He's not talking to the military. It's not like he thinks chain of command is going to put out orders to do stuff to civilians at the ballot box. First off, any service member worth their salt would deny that order because it's against the Constitution. And secondly, like –

You're crazy. He is fantasizing out loud about turning the military on civilians. It's not going to happen. And it is scary as shit because he's talking to folks who would dissent from within the military. There's about 10% that they look for that would break ranks and use their position to help him with a coup. But it is scary. If not that, it's the fact that there are militias, independent militias, who are –

actively attacking right now, like you mentioned, FEMA workers in North Carolina. Because he lied about FEMA. Because he lied about FEMA. I got a DM from someone today that she used to live in Asheville. She now lives in New York. But she had spoken to someone. A friend's friend is down there through FDNY and was led out of a house at gunpoint for offering water. Yeah. Because Trump told them that if they accept any FEMA help,

FEMA and the government will seize their property. Yeah. Which is not true. They are texting us that he has to be careful in rural areas who are escorting non-locals out of their towns because he's associated with FEMA. They are just leading people who are firemen and trying to save their lives or offer them water out of their spaces by gun. And he's just a guy who's down there trying to help. And this is the danger that, look, people talk about, you know, boiling the frog and how all of this rhetoric escalates.

It is this. It is through this. It is through the fact that when he said they're eating cats and dogs at the debate, people laughed. That's so outrageous. They doubled down. They doubled down on the dehumanization of immigrants. They basically said, yes, this community is engaging in this. And now they have depleted trust in the federal government altogether.

Saying that Democrats, possibly Jews, control the weather. Well, you guys have the space lasers. Look, things would be very different if I had any control over anything. I know. He's doing really dangerous things, and I think that we need to call them out, including he's now added photos of fairly ethnically ambiguous Latino-leaning people.

to these huge poster boards he puts up and says, these are the types of people, if you see them, these are the types of people who are doing disgusting things I can't even talk about to our women. He's creating crimes that didn't happen. He is putting it on the faces of people who are maybe AI generated. I don't know what,

It's going on there. And the purpose of that is so that if you see anybody who you think looks like this, it gives you as a person who follows Trump, maybe the option to think, oh, I should help. I should defend. I should do whatever. I have talked about this time and time again. He triggers the protective instinct of people in a very sick way.

Yeah. And it was at the RNC and at his subsequent rallies that they had mass deportation now signs. They are actively planning to use existing U.S. law to deport people, to strip people of their citizenship. This is going to happen under his regime. He also has floated using a law from, I think it's 1786. He's suggesting the Alien Enemies Act of 1798, which...

Was used to to inter Japanese people in internment camps. So, you know, it's not just that he's going to round up and deport all these people. He's going to round up and enslave all these people. I think that he has a goal here that is very sick and twisted. And I genuinely think that he is a man in mental decline and he makes no sense. And to some people, that doesn't matter. But it's something that we can't just pretend isn't happening.

Well, I think what people need to be prepared for is that MAGA has an heir now. And he's very good at putting a bow on it. J.D. Vance is. And he will continue to carry this torch in a much more competent, eloquent way. Josh Hawley, too. Josh Hawley was out there with Harrison Bucker saying women should just step aside with a straight face. They mean it. They're telling you what they mean. And their laws...

to that. But you know what you can do? Abortion is on the ballot in several states. Swing states too. We should make a graphic of this and put it on the Betches News Instagram. I did not know that abortion was on the ballot in New York. It's not.

Indeed. I was watching a thing yesterday. So my neighbors have two signs. One says vote no to Prop 1 Save Girls Sports. And I was like, whatever stupid thing this is. I don't know. I thought maybe it was a local thing and they were going to end Title IX or something. And then...

And then there's another one that says vote yes for abortion access prop one. So I've gotten to looking it up. Abortion is on the ballot in New York. We think we're a safe little blue state. You might think you're in a safe little blue state. We are not. Right now, our state constitution protects you from unfair discrimination based on race, color, creed, and religion, but not sex, sexual orientation, pregnancy status, all this other stuff.

You have to vote yes on Prop 1. That enshrines abortion into the New York state constitution, also extends protections on the basis of sex, pregnancy status, and LGBTQ inclusion. And if that doesn't get you off your ass...

I don't know what will. But I'm an informed person, and I was like, what? Prop 1? I've not heard of this. So there's a couple more. I think these are the sort of things that you find out usually are closer to Election Day. That in itself might be something that needs to be fixed in a broader civic matter. But yes. Okay, yes. Because we have other states as well.

Listen up. Your state might get called. In Arizona, you want to vote yes to Prop 139 to protect your reproductive rights. In Colorado, it's yes to Amendment 79. All of these have different types of names.

In Florida, it is yes to Amendment 4. Remember, yes, you are for the bill. Amendment 4. In Maryland, it's yes to question one. Question one. You're number one. Missouri, yes to Amendment 3. I don't have a nice mnemonic for that. Sorry. Just you got to remember Amendment 3. Yes. Montana, you're going to be voting yes to CIL.

I don't know what CI stands for, but you're voting for CI. Constitutional Initiative, maybe? Maybe. Montana, yes to CI-128. Nebraska, you are the only people on this list who is voting no on your abortion measure. You are voting no to Initiative 434, which prohibits abortion after the first trimester. But you are voting yes to...

to Initiative 439, which protects the right to abortion before fetal viability. So Nebraska, you write this on the back of your hand or something. It's no to 434, yes to 439. They're trying to do it two ways. 439, feeling fine. 439, feeling fine. 434, you're on the floor. You're on the floor. There we go. Okay. Listen, Nebraska.

It's you. Keep it real. 434, we're on the floor. 439, we're feeling fine. Exactly. All right, next up. Nevada, yes to question six. And lastly, South Dakota, you're going to vote yes to amendment G. Okay. Everyone remember. We did it. Put up a graphic on Betches News. Church's original recipe is back. You can never go wrong with original. Thank you.

Still tastes the same like back in the day. Right now, get two pieces of chicken starting at only $2.99 or 10 pieces starting at only $10.99. Churches. Offer valid at participating locations. We all have plans in life. Maybe to take a cross-country road trip or simply get through this workout without any back pain. Whether our plans are big, small, spontaneous, or years in the making, good health helps us accomplish them.

At Banner Health, we're here to provide more than health care. Whatever you're planning, wherever you're going, we're here to help you get there. Banner Health. Exhale.

So, I mean, there's that. And then if you're still an undecided voter, I'd really love to hear from you. Like, what can we be doing? We've got, you know, 20 some days left if you listen to the show or if you talk to people in your family that say that they're still an undecided voter. What is it they're undecided about? How can we help them make that decision to vote and make that plan to vote? It takes different things for different folks. And I know there's 1.6% of the population that's going to vote for Jill Stein that's causing 100% of the problems online with the rhetoric and the hate.

This past weekend, there was a whole fallout where Jill Stein stands attacked Angela Davis, the civil rights leader, Angela Davis's legacy and black people in general, truly showing their colors that the Jill Stein voter is very anti-black.

and potentially moving further right than we would have thought. They kind of got mixed up with the RFK junior voters, and those people are for Trump. So a vote for Jill Stein is a vote for Trump. She has said that. Her team has said that. She has said that her goal is to punish Kamala Harris. And I think if your goal is to punish Black women, you really need to check where your advocacy is laying and who your leader is. I am deeply concerned about this because in 2016,

Hillary Clinton lost by a margin far smaller than the number of Jill Stein voters, especially in the Rust Belt, each of the three Rust Belt states. She is really doing can do a lot of damage. And I think what people need to understand most importantly about Jill Stein is that she is an arm of a foreign influence operation by Russia to elect Donald Trump. This is part of a foreign attack.

In which our election is a big battle. And she doesn't deny it. That's the thing. It's like she doesn't deny it. And her followers still. That's why I don't mess with Jill Stein followers, honestly, because like y'all have made your decision and I have to work on new people. You have said you hate the Democrats. They're the most evil people alive. You're willing to give it to Trump because you want to punish black women. I think that's a weird take.

But let's say that you do have a friend who has fallen for it. Let's say you know someone who has kind of gotten caught up in the possibility of a third party candidate. Please enlighten them about the reality of Jill Stein.

And that not voting is better than voting for her. She's a dangerous person in the fact that she only comes around every four years. She has no down ballot support. She has no cabinet to fill. She has no nothing. And when it comes to her falsely claiming that she would end the war in Gaza-Palestine, please do not forget that she is in cahoots with Assad.

and that regime in Syria. And she's very open about these things. So this is what I'm saying. Facts don't care about your feelings. And if we want to base our vote on policies and not personalities, then please let's look at the policies. Jill Stein is pro-Israel, pro-Assad, and those are of her own words. And so it doesn't matter if she wears the keffiyeh or if she tells you that she's going to do all of these things. She doesn't have the power or the interest to do it. None of those things make sense. Pro-Israel and pro-Assad makes no ideological sense.

Neither does her wearing the kathia. She's like a visual representation of the foreign influence operation. If you want to actually have a depiction of it, you have Jill Stein. And here's the thing. I'm not talking about people who a couple months ago were looking at her and going, hey, that's so interesting. I never heard about this lady before. I'd love to learn more about it. And now we're like, oh, no, oops, I did learn about it and I don't like it. Like we've said, if you're looking for a third party, look to the Working Families Party.

Which is building a progressive platform on top of the Democratic Party to make that, you know, using the MAGA kind of like theory of we have to build from within and then we can make a flip to a more progressive future. Or just get like less hung up on this whole party idea in general and try to vote for the policies. Vote for who is going to get you closer. Look at it like I make this up. Look at it like a bus stop, not an Uber.

What will get you closer to the place you want to be? Not someone who's a chaos agent. And she is a chaos agent because that's what happened this weekend. Some of her followers, it's happened to me a million times. It's now happening to other creators where somebody will come out and be like, the Democrats are paying them thousands of dollars to shill for Kamala. And it's like,

It's because you as a Jill Stein voter or as whatever version of leftism this is could not possibly conceive that there are people out here who are advocating for democracy and for her policies because they directly affect us and we care about them. You would only do it for a check. And every accusation is a projection.

Yeah, it's, it is really hard. It's become really hard to have a conversation or exist in this, this information environment. I really do feel for lack of a better word, a little bit paralyzed by it. And, you know, I'm going to try to, you know, keep overcoming that, but it is a lot and you're not crazy. Charlie Warzel wrote an amazing piece in the Atlantic. It's called something like, it's hard for me to tell you how bad this is. And it basically is kind of

confirming that you're not crazy with what you're seeing online. And one more thing before we go. On Thursday, we have an incredible episode for you, an interview with Gabriel Sherman, the Vanity Fair correspondent and writer of the new movie, The Apprentice. It's basically a biopic of Donald Trump, Donald Trump's early years, starting when he was collecting rent from his father's tenants in Queens. And it

his relationship with Roy Cohn, who was played by Jeremy Strong. The acting in this movie is so stellar. They really get lost in their roles. Donald Trump is played by Sebastian Stan. And the movie had quite a winding road to get distributed. It got an eight-minute standing ovation at Cannes. No

No one really wanted to distribute it or give it a streaming deal in the United States. They did a Kickstarter. CBS and ABC have both refused to air the trailer for the movie during the debates. I think that's censorship. I think that's so weird.

I think they shouldn't be allowed to say that. We're not going to air the trailer. I don't think they should be allowed either, but I kind of get the decision. Sure. But I think it's kind of messed up. It's like if you didn't want to be this person who has this movie made about him, then you shouldn't. Would they let a movie about Kamala be aired, a trailer about that? Sure they would. Well, that's the thing. It's like this movie was originally funded, remember, by Republican super donors. Dan Schneider, who owns the Washington Commanders, was one of the lead investors in this film until he saw the film.

And he was like, I don't like the way this depicts Donald Trump. And they were like, but it's true. We've been on this creative journey the whole time and we're not going to change it. He was like, well, then I'm not going to give you any more money because he didn't like seeing the truth of Donald Trump in front of his face. Yeah, I do think one thing as someone who has read stupid amount of biographical information about Donald Trump and how he came to be where he is is.

This movie really packs the information in. And if you want a real accurate picture of the anecdotes that shaped him down to the script of the conversations that he's having with his father and his brother, and the way that those relationships are depicted, this is the movie for that. And anyone who thinks that he has come up and made himself a millionaire should definitely watch this movie. It's really...

incredible film. So listen to Gabriel Sherman on Thursday's episode. Speaking of stuff that I'm super excited to come out today, Bob Woodward's book War comes out. Now I did get an advanced copy because Humblebrag

Me and Bob are friends. I don't know. I'm going to use the word friends. I bet he would just describe it as you're a nice kid that I met a couple of times. Colleagues. We're colleagues. We're peers. Yeah. From my days at the Washington Post. I really respect Bob Woodward. You guys all know who he is and whatnot, but I've had the opportunity to be one-on-one with him in a way that was very validating and affirming to me. Because when I asked him where he went to J school, he's like, I didn't. I was in the Navy. I was like,

Oh, okay. So I think it just shows you can be great no matter where you come from and everybody's story is interesting. And sometimes not going the traditional path can make you a great storyteller. So thanks to Bob Woodward for being a friend. This book is really something. And a lot of people are pretty pissed off, Sammy, because they think that Bob shouldn't be sitting on these secrets until his publisher allows him.

I mean, that has been my gripe against Bob Woodward. Please let him know. Since 2020, when we learned about COVID, or maybe it's 2021, we learned that COVID is basically... He knew about it in February and he knew that it was deadly and he knew that it was...

It was spread through the air and it was worse than the flu. And then he lied. Look, what I will say is that my understanding is that this is not only a decision by Bob Woodward. This is a flaw with the publishing industry that they basically don't allow journalists who get book deals to release any information that would be considered wrong.

like spoiling the book or taking the exclusives out of the book. Yes, this is a real issue, but Bob Woodward is not the only person who deals with this problem. Should Bob Woodward maybe put all his shit on sub stack when he gets the, that's the, uh, T maybe, but maybe they wouldn't tell him. Maybe they wouldn't, he wouldn't be able to get this type of access in the way he does if,

Here's what I noticed when I was at his house. He records everything. He even recorded all of our breakfast meetings. Every time I've ever spoke to him, he says, do you mind if I record this? He records everything all the time. There are two phones in his house and one is like his phone and one is his Trump phone.

And that phone line is constantly recorded, which he has talked about, I believe, in the books. I'm not spreading any secrets about him. And it's because Donald Trump will call him like five, six times a day. Not all the time, but when he thinks he's getting attention from Bob Woodward, Donald Trump is extremely flattered by him. And he calls him and Bob's like, I'll sit on the phone with him for hours sometimes. And he just...

It's like he doesn't have any friends. He just talks and talks and talks and talks. And Bob's recorded all this stuff. Now, this whole thing – Bob is not the only person who has said that, by the way. No, Roy Cohn, his original mentor – and you'll see this when you watch the movie The Apprentice – also said that Donald Trump is deeply insecure and will call him 15, 20 times a day. This is how he is. He does not have the ability – He does that to the donors. Because he doesn't have the ability to form – All the reporters says he does that.

He can't form his own opinion. He is not a foundationally secure person. He needs to steal from everybody and then kick it back out. He needs constant affirmation and loyalty. So he calls Bob Woodward all the time on the Trump phone and they're recorded and then they go through it and he's like, he knows everything he says to me is going to likely go in a book or be published.

I am not his friend. I've never tried to fake endear myself to him, make him think that we're friends. I am Bob Woodward with the Washington Post. And you call this phone when you want to tell me something that will likely be published. But Donald Trump is so desperate for friendship that he like doesn't believe that's true. And he thinks he could like tell Bob secrets.

So that's how this is. That is how this relationship is set up, because now Trump is saying, I never called him. I never did anything. Well, baby's got the tapes. OK, if there's one thing Bob Woodward has, it's a tape. Well, the other thing with this is that I think it's possible that we may never have this information if it didn't come about in this way.

Like if Bob Woodward were publishing weekly columns about his conversations with Donald Trump, that would be... Trump would never speak to him. But because it comes about in this like delayed way, he thinks he can trust him. He'll just say...

All of you just hear the most egregious things. I once again will say Donald Trump is a short-term thinker. So if he tells Bob something on a Tuesday and it didn't come out by Friday, he thinks he can trust him. He never said it. He never said it. And he thinks, oh, he is my friend. Some of the things in the book that are really interesting were the fact that Trump chats with Putin on the phone quite frequently, gave him COVID tests when we didn't have them here in the United States. Not just COVID tests. Abbott machines.

When it was like the height of the first COVID wave and he sent him Abbott machines, like the original version that hospitals needed. Not only that, but Putin basically says, you know, thank you, but don't tell anyone that you sent these to me because they will get mad at you, not at me. So he not only gets the COVID tests, but he gets like a little something on Donald. And Trump says to him, I don't care.

He says, they're going to be mad at you, daddy. They're going to be mad at you, daddy, because you're so secret with me. And Trump goes, I don't care. I love you. I love you, Putin. It's so sick. Here's a couple other things from the book that I think are really interesting. It

It's not just Trump tapes either. It's like Bob has access to lots of people. And I think it just speaks to the way that old men spill the beans to each other. And I kind of love that idea. I like picture them all sitting at a Dunkin' Donuts talking shit. And there's Bob Woodward just kind of like with a tape recorder. So General Milley said that Trump is a fascist, quote, the most dangerous person to this country.

Donald Trump said of General Milley saying that Trump is a fascist, I will order them back to active duty and then I will court-martial him. This is something that's actually quite concerning not just to General Milley but also to General McRaven who was in the running to be Kamala's VP.

Milley called him fascist to his core last week. Yeah, he's very honest about it. And he is very concerned that he will get called back to service and court-martialed. And he's like, I don't care. This is, you know, it is what it is. Now, when it comes to Biden- Well, that's why Mitt Romney is, quote, joking about having to flee the country. Michael Cohen is openly talking about how he's going to leave the country. And I mean, he'll be number one. On TikTok Live every night that Michael Cohen-

It's not just him. There's stuff that Biden has said. Biden swears a lot. We know that. And that is deeply revealed in the book. He says that he heard Biden privately say about the Israeli prime minister Netanyahu, that son of a bitch, Bibi Netanyahu, he's a bad guy. He's a bad fucking guy. Biden also said that fucking Putin thing.

Two advisors in the Oval Office not long after Russia's invasion of Ukraine also claiming Putin is evil. We're dealing with the epitome of evil. Woodward also wrote that Biden's national security team at one point believed that there was a real threat, a 50 percent chance that Putin would use nuclear weapons on Ukraine, which is extremely scary. And Defense Secretary Austin talked him down, which I think is one of the most

That doesn't really get put in as much. I don't think people really are aware of that. But Biden's administration was able to talk the Russians down from just verbally.

using diplomacy. And I really think something that goes missing is, and especially as we're talking about Iran and Israel, there is power in diplomacy. America still has that amount of leverage. There's so little time left to save that leverage. And I wish that that had led the headline, like Biden's administration prevented nuclear war.

Because that's what happened. Well, and Austin also got us back on the right track with the Philippines, as we talked about a couple weeks ago. I think Austin and the Secretary of Defense and the stuff that goes on at the Pentagon, we don't really give it the credit that it's due, but they're really holding it down out there. Biden apparently also said that he should have never picked Attorney General Merrick Garland.

Because of his son. Because of Hunter. Yeah. Biden also apparently criticized former President Barack Obama's handling of Putin's invasion of Crimea in 2014, concluding that Barack never took Putin seriously and now we're fucked. I just love thinking about Biden saying the F word this much. I will say, I think that there are some threats that

Obama might have slightly underestimated. And Putin is one of them. And I'll admit, I myself laughed when Mitt Romney said that Russia was our biggest political threat, the 2012 debate. I was like, what is it, the Cold War? I know. And he wasn't, I mean, and maybe they weren't as much of a threat at the time, but what Putin's aspirations were, were. And, you know, that was a thing. It was like the red line in Syria, you know. They're all been festering and now here we are. Mm-hmm.

Now, it's not just major politicians like the former presidents that Woodward gets tape from. Lindsey Graham also loves to call Bob Woodward and chat with him. He once said to Bob Woodward, going to Mar-a-Lago is a bit like going to North Korea. Everybody stands up and claps every time Trump comes in. This is the kind of shit we need to know because it emboldens him. He's created a fake bubble for himself.

And you can find that out when you watch The Apprentice movie, exactly how that happened, at least up until like the 1980s. He also says that the Saudi leader, bin Salman, had an aide bring over a bag with about 50 burner phones in it because that's how Saudi Arabia apparently speaks to other diplomats and politicians.

And he has a phone that's labeled Trump 45. This is what, you know, Saudi Arabia's got him on speed dial at one of his bag of burners. He also had a, to be fair, he also had a phone for Jake Sullivan, who is Biden's national security advisor. But it's, don't you find it interesting that he has the burner? I mean, Bob, I think it's weird that Saudi Arabia's crown prince has a burner for Trump to answer the phone.

And one, yes, for Jake Sullivan to answer the phone for Biden in the capacities of his job. He doesn't have a Biden 46 phone. I think that that's a key difference here. He's got a line to Trump answering the phone, not to the NSA, which makes sense. That and Trump is no longer in power. Why should he be doing this? He's taken too many –

Do you think he dug through all the phones? Oh, my God. I just picture him like, yeah, just like a little grab bag. Let me find my T45. Can I have one? I know, right? So, you know, and so CNN did a good recap of it. I do think it's worth reading. I don't know who did the design of the book, but it looks pretty rushed to me. And that's my only critique of the book so far.

But CNN says that war offers a glimpse into Harris's private dealings with Biden as his vice president. I'm interested to read about that. Haven't gotten to that chapter yet. And that Woodward writes at one point she was concerned about Biden's isolation and was calling on his closest associates, quote, I'm calling to ask you really to beg you, can you please talk to the president more than you do? Your president really loves you. You should talk to him more often than you do. I think that's going to be interesting to see.

Yeah, I think a lot of this is going to be interesting to see how it plays out. And it all hinges on

on the election. Here we are. So get ready. Well, let's get it wrapped up. That'll do it for us this time. Don't forget to help us and our good Judy A.B. get her brother released from prison. Make sure you check out The Apprentice if it's in a theater near you. And that's it. So starting next week, episodes are going to be released at 6 a.m. instead of midnight. That's a little bit of a change, but you early risers will still see it in time for your morning commute. Until next time, I'm Vita Spear. I'm Sammy Sage. And this is American Fever Dream.
