But in a five-page ruling, Judge Tonya Chutkin says waiting to release the files would be an act of election interference. Numbers say it is a tie game here weeks before the election, and it's that shift. Our last poll taken in the wake of that September debate, Harris had opened up that advantage over Trump. Gone in our new poll now versus September on the immigration and the border. We asked voters who would be better on this. In September, Trump had a big advantage. It's gotten bigger on inflation and the cost of living.

Should have been out by now, by the way. Guess the First Step Act doesn't apply to Stephen K. Bannon because under the First Step Act, he could have been out a month ago. But the DOJ apparently doesn't care about that. No, no, no. Understand.
What they did to Steve Bannon is what they want to do to all of us. I guarantee you, if Merrick Garland stays as Attorney General, they're going to take out every single one of us. They're going to come after me. They're going to come after Charlie Kirk. They're going to go after Donald Trump's family. Donald Trump will certainly, and just be clear about this, if Donald Trump does not win the election, they will put him behind bars.
They will. It is a certainty. Okay? And Letitia James, who was there at that Al Smith dinner, by the way, was laughing about it. That's why she's clapping. Because she knows, and yeah, Trump did a great job there, but she knows that if he doesn't win the election, she's going to put him behind bars. And she can't wait to do so. She's trying to do the same thing to Biden again in December.
So wake up. We're going into the weekend. We're going into a time where you need to vote.
I've already voted. My parents have voted. Why haven't you voted yet? And then once you have voted, you need to do the same thing I do. And you need to be intimidating all the people within your circle and bully them. Bully the vote. We need to be bullying the vote. The actual grassroots movement is really, really on the side of the people this time, and that being what they call MAGA Americans. It really feels that way. But I don't know if that's just because I'm in Florida. That's what I'm seeing. I'm in my own silo. But touch wood, may this translate into the result that needs to occur this election.
Well, I think that's great, and I've also told a lot of people out there, people are voting early. I'm seeing this. I've got a number of events this weekend. I'm going to be down in North Carolina. I've also got an event in Pennsylvania that I'll be attending. I'm not revealing that event yet, but people know there's a lot of different events. Elon Musk is crisscrossing the great swing state of Pennsylvania, my home state.
and we're seeing incredible energy, the likes of which that I didn't even see all the way back into 2016, but that's why we put the book together on the Trump assassination attempts. By the way, I'm just seeing now, crossing my desk, and I know you and I were just chatting about this, that Judge Eileen Cannon down there in Florida,
who's overseeing the case of Ryan Wesley Routh. This, of course, will come up on November 14th, so just about a week or so after the election. Ryan Wesley Routh has requested that Judge Eileen Cannon recuse herself from the criminal case. Taken together, these unprecedented facts and circumstances might create an appearance of partiality in the mind of the public.
Accordingly, the Constitution and the federal accrual statute, blah, blah, blah. So, yes, they have filed a motion to recuse these attorneys. We have no idea how he's affording these attorneys or paying for them, by the way. Unique and unique facts and circumstances. And essentially what they're saying is and this is what they're saying, that the fact that she was nominated by President Trump and Ryan Routh is charged with attempting to murder
murder President Trump. They are claiming that she has a conflict of interest because the person who obviously was the subject of the assassination plot was the person who nominated her. Viva, you know, we weren't planning on doing legal analysis here, but I've got to ask you with your, you know, with your lawyer's hat on, have you ever heard of something like this taking place?
Oh, I certainly have never heard of anything like this taking place. I never did criminal law even up in Canada. But can you appreciate what the argument is here? That she was appointed by Trump, so she's going to be partial to Trump,
As if to suggest someone who, he wants a judge who's not going to be partial to the person that is alleged to have been the victim of the assassination. I mean, flip it another way. All judges, or at least federal judges, are appointed by presidents and he tried to kill a president. So he should not have a judge because any judge is going to be biased that the person would try to assassinate the political leader that appointed them as judges at large. I mean, it's idiotic. I don't know who the other federal judges in Florida would be.
That would be potential to take the realm of the, the helm of this. But if he's going to say, I like that, which by the way, let me, let me, let me, let me, let me ask this though. So shouldn't, by the way, shouldn't judges be biased towards, towards the lie, the livelihood of any federal official, by the way, not just ones who appointed them, but regardless of, you know, the, the politics of it, shouldn't a judge be partial to, uh,
It's not a political question that a judge should be anti-assassination. I would hope that a judge, that it's not a question of partiality, that, well, no, even if I, you know, let's say that Biden had, you know, appointed her, I would hope
that she doesn't want Joe Biden assassinated either, or Barack Obama, or if Kamala ever became president, right? This is wild. I tried to kill President Trump. He nominated you, and therefore you shouldn't be on the case. No, that's insane. No, I'm sure he would love Judge Mershaw, but that's a state judge. I'm sure he'd love Chutkin. Get Chutkin in this case. Right, right, that's what he wants.
No, it's patently preposterous just because you follow the argument and the argument would be, well, the judge was appointed by a president. I'm accused of trying to kill a president. Therefore, the judge is going to be biased. It is amazing. So he's not a pro se litigant. He's being represented by an attorney.
That's right. That's right. He is being represented. And there is an attorney who made this argument that because because his defendant, which, by the way, he's pled not guilty. So he's pled not guilty to this because it it also sounds a little bit like, you know, there's a question of admission of guilt here, because, you know, if you've pled not guilty, then in saying that there's bias involved because.
because Donald Trump is involved in the case, well then, what exactly are you saying? Are you admitting that you were attempting to do something malicious towards Donald Trump? I mean, it's absurd. I'm sorry, this just seems completely absurd to me.
It's absurd. You can't blame them for trying. And then they'll do this and they'll say, look, now the judge is being hostile to us because we made a bunch of ludicrous requests. Now that I'm thinking about this, Jack, I might have to go attend the trial because it's not going to be more than 45 minutes from where I live here in Florida. Yeah. Now that I'm thinking about this. Yeah. You're in, you're in like Sarasota, right? No, I'm on the east side. I'm like, I'm like a little north of Fort Lauderdale. So this might actually be. Oh,
Oh, okay. I thought you were over with the rumble guys. No, no, I'm 45 minutes from Mar-a-Lago. So if this is the courthouse where I went at one point in time for one of the Trump cases, it's like an hour away. I don't know if it's going to be, if it's federal, they're not going to be broadcasting it live, but it might be open to the public. You need to go. You need to go. We need you there.
We're going to need you there and we are going to need you on doing the shoe leather just like you attended. And well, I know you didn't attend. I attended, but you were covering the Bannon case two years ago. You've got to do this again and just give us the details as to what's going on, because this is a case where and you and I were just chatting about this on your channel, but.
You know, there's so many questions that are opened up in this case. How was this individual able to procure a firearm like this? How did he get the plates that he had? So he had constructed this sort of sniper called it's called a hide site. The sniper's nest that he put together with ceramic body armor that he then placed on the fence to conceal himself.
And I've gone through and I've spoken to Eric Prince about this, that this was training that he more than likely received while he was in Ukraine. This is a rudimentary hide site or sniper's nest that he put together. And then we found out using AI facial recognition that he was in a...
in an Azov battalion propaganda video and that was something that that I found at I was quite surprised I was like man Alex Jones is really right this time and just throw throw all the money in the Alex Jones was right jar he said the CIA is trying to take out Trump and said well okay this guy is connected to the Azov battalion and the Azov battalion was trained by the CIA and
to conduct assassinations. Darn it, Alex is right again. I mean, this is gonna, but let me ask you this, and we have a minute till the break, but would you expect any of that to come out in court? I mean, it can come out by accident. That's the thing. I presume the arguments are gonna be irrelevant. He's accused of a certain crime. Here are the facts, et cetera. And so don't bring in extraneous, what they might call more prejudicial than beneficial evidence. But things are gonna come out by accident.
And so it is going to be a wild trial to follow in real time. The idea that he appeared randomly in an Azov battalion propaganda, which I saw at the time, okay, accidents can happen and there could be coincidences. But at some point, as Steve Bannon said, first time's an accident, second time's a coincidence, and third time's enemy action, something along those lines. But no, I'll be following this trial thoroughly. It's going to be fascinating.

motion that's been made by Ryan Wesley Routh saying that he doesn't want Judge Eileen Cannon because she was appointed by the guy he tried to kill or that he certainly intended to kill. And by the way, there's a letter saying that he intended to kill Trump by his own hand. But Viva, you threw that quote out about
first time is happenstance, second time is coincidence, third time is enemy action. That's not actually Steve Bannon. That's James Bond. That is from Goldfinger and Ian Fleming. Steve Bannon's quote is, there are no conspiracies, but there are no coincidences.
Well, now I'm going to get fact-checked because I've been attributing that to Bannon for a long time, which segued us into this conversation. My chat was asking what the update on Bannon is, and now we're discussing that. There was some talk about him getting out potentially a little earlier, or at least the week before the election, but a little earlier, and now you've mentioned that that's not going to happen, or at least that's not what the feds are going to do. Here's the say to play. I got an email from Bannon last... I read it last night.
Saying that and he wanted to keep a close hold for the time being but he wants to put this out and and when I so Ben and I are able to now communicate through the the the DOJ app and with you know I'm sure Merrick Garland looking over our shoulder and everything and all his thugs, but he said he sent me an email last night that said the Bureau of Prisons finally admitted today that I am in fact eligible for the first step act the FSA however
The DOJ is using a technicality to keep me imprisoned. And Rahim Kassam over at the National Pulse has the article up on this.
And so people remember, of course, the first stepped act was exactly meant for this type of thing, a nonviolent first offender to get them out of prison earlier, to put them out. And he's released a statement now to just one hour ago to the National Pulse saying that let me go through here. Let me go through here.
Kamala Harris has done nothing to implement President Trump's Heroic First Debt Act, in fact, welcoming hundreds of thousands of hardened illegal migrants, criminals, while allowing U.S. citizens eligible for early release to rot in prison. No mass deportations, but continual mass incarcerations. And so think about this. So on August 29th, Bannon filed a motion to reimpose bail or impose a period of supervised release.
the government's response to the en banc petition had been pending for over seventy five days his lawyer said the court should grant bannon's motion for bail upon completion of supreme court review in order the bop to release mr bannon immediately
And he says again to Rahim Kassam that the Harris Bureau of Prisons is illegally holding me past my legal release date. Remember, the First Step Act is still on the books, folks. They are trying to eliminate one of President Trump's strongest advocates, and these criminals reek of desperation. Remember, this was passed in December 2018, aiming to reform the federal prison system by reducing sentences for nonviolent crime.
offenders and key provision allows inmates to earn time credits through participation in educational and vocational programs potentially leading to early release into pre-release custody such as halfway houses or home confinement and then of course the law also expands compassionate release for the elderly or terminally ill prisoners uh steve bannon is uh 70 he is 70 years old and clearly would qualify for all of that and yet kamala harris
Her administration and Merrick Garland refuse to invoke the First Step Act for him. Viva, why is it that when I turn on CNN and, you know, our good friend Brian Groduski is on there, you know, just trying to give some facts, they say that Donald Trump is going to lock up his opponents and Kamala Harris says this to Brett Baier and then Steve Bannon is in jail. You covered the trial two years ago. It was ridiculous. It was a farce. He
he obviously they're not going to let him out early because he should never have been in jail in the first place but you know the first step back is is only open to those who who lick the government boot and and say i love you big brother and he should never have been locked up in the first place that he was sentenced and served his time before the appeal could be fully heard uh you know so they're obviously they're not going to let him out early because he shouldn't be in jail in the first place yet he is and it's sort of like um
If you listen to the judge who just sentenced Tina Peters out of Colorado to nine years in jail, the way he lectures the criminals who are the unapologetic criminals, because Tina Peters wasn't apologizing for what she did. She believed in it, as did Steve Bannon. Well, of course, they're not going to let him out. They're going to throw the book at them because they're not one of the poor drug addicts or the poor uneducated criminals. Who doesn't know better? They get to get all the benefits of the law.
So this is obviously by design, keep Bannon in until I guess his scheduled release date is the week before the election.
No, but it's par for the course. And yet you get Kamala Harris sitting down with Brett Baier, lecturing him and the world about how Trump is going to be the dictator who locks up his political opponents. It's just the ultimate irony. It's the party that talks about criminal justice reform that will let out the violent criminals, but then lock up the political prisoners. And like you mentioned in your book on humans, this is anarcho-tyranny in full force, in practice, by deliberate design.
But it's deliberate design. It's anarcho-tyranny. So if a criminal commits a crime, then they are acting on forces of oppression and they are lashing out against the oppressor. But if you or I were to be caught with a knife, well, then we are a potential domestic terrorist.
And so it is this deliberate twisting of the law to put it on certain groups for someone like you or myself or someone like Steve Bannon, who was President Trump's chief strategist in the White House, that the book gets thrown against you. But if you are a drug dealer or someone else.
Well, you get the first step to act. You get criminal justice reform. You get all of these things with Steve Bannon. No, Steve Bannon has to rot. Again, we are seeing, and I've actually, we used to say two-tier system of justice. I go three now. I've realized there's actually a third tier, and I figured this out.
Because we used to think it was two tier. No, that's actually three. Because we know that there's the tier for Trump and Trump supporters that you get you get everything thrown against you. And apparently I haven't I haven't seen the full interview yet because we've been on air. But apparently when Trump was on Bongino show earlier, he compared the incarceration of the J6ers to the internment of Japanese Americans during World War Two. And the left is losing their minds that he was I was obvious parallel.
Dude, I'm listening to it, and I was sitting there thinking, like, I was listening to this live as it's going. It's like, I want to make a montage of what I know the left is going to flip out about. There was a point where he, you know, the fumbles, the hesitations, they want to make him look tired and whatever.
When he said that, I was like, oh my goodness, he's comparing the Jan Sixers to the injustice of locking up the Japanese based on perceived threat. It's an absolute analogous comparison. And the treatment by the courts that has been sanctioned by these politically biased judges is absolutely analogous. So flip it all you want, you're crying lefty Democrats.
It's what was done back in the day. It's what's been done throughout the history of the Democrat Party. And when he called them, that was during the AI, the Al Smith dinner yesterday, where he says, like, call them Democrats because it sounds worse than Democratic. But it's absolutely analogous. But that is because past is prologue. And as they say, you know, the more things change, the more they stay the same.
Precisely. So that's that's tier one, right? So tier one is the book is thrown at you and you're a Trump or a Trump supporter. Then there's tier two and tier two is sort of like, you know, the the obvious, you know, the like, you know, you're driving over the speed limit, you get pulled over that type of thing or red light camera that just just your basic everyday run of the mill, the common man laws. And then there's the third tier.
And the third tier is the secret tier. And the secret tier only exists for people whose last names are, oh, I don't know, Biden, Clinton, Obama. And when you're in that tier, you can get away with pretty much everything. You can not file your taxes. You can do whatever you want.
And you will get away scot-free. And don't, by the way, don't believe for a second that Joe Biden isn't going to pardon Hunter on his way out. Can we all just agree on that? He's obviously going to do this on his way out of office. There's no reason that he wouldn't. He's not running again. This is done. This is the end of his political career. He's going to pardon his son.
He clearly will do this. So that is, those are your three tiers that we live under now. And, you know, like I was saying before, the point of a system is what it does. When a system wants to lock up Trump supporters, when a system wants to use intentional neglect to
to not give President Trump the A-team when he's doing an outdoor rally in a place called Butler, Pennsylvania, then they are going to give him the B-team, and this is all going to happen on purpose. Again, the point of a system is what it does. Last minute I have to you, Viva Frye.
Oh, no, I was going to say it is designed to shut people up and make them live in fear. And in as much as they failed in the assassination attempt on Trump, the incidental benefit might be that he'll have to hold smaller rallies to not expose himself. And so they'll succeed that way. With the Tina Peters case out of Colorado, sentencing someone to nine years in jail for election denialism on the eve of the trial, they're sending the message that
that if you challenge the election and you're a politically disfavored person, you will go to jail for the rest of your life. So don't challenge elections. Don't go to protests. Don't exercise your constitutional rights because they'll lock you in jail like Tina Peters. They'll lock you in jail like the Jan Sixers. And they will give the free pass to all of their political brown shirts, for lack of a better word, who will literally get away with murder, literally get away with burning buildings down because, you know,
They don't expect more from them and they don't get the subservience that they want from their political adversaries. That's why Bannon's in jail. They're never going to let him out early because what they want is the subservience and the admission of wrongdoing that they will never get from him. And that's exactly it. But walk me through some of your reflections on having been with the family and really just being at Butler after we've put this book together. You know, I went and we did the site survey, but it's totally different experience actually being there with the president and with the family.
It certainly was, Jack. Thanks for having me on. I appreciate the invitation to come to Butler. It was so important to me to be there for the memorial for Corey Compertori, the special moments there where his firefighter uniform was there at the very spot where he was shot and killed by Thomas Matthew Crooks following these so-called security failures. And that's what boils the blood more than anything. So

that there was a trained marksman 140 yards from President Trump. Now, seeing the site there in person, you get a completely different feel for what you witness in the video when you're there in person. to have gotten through in order for him to be that close. And also, in the hours prior, in that day, there were more than a dozen, many dozen, quote-unquote security failures. Have they offered information as to what was going on in these emails, as to who he was talking to on these encrypted apps, onto all of the information that's going through?
No, because guess what? They have a right to know because these two girls lost their father and this wife lost her husband. And they did so because of your lack of security. That's why they lost him. He should be home right now. He should be with them, but he's not. He never came home from that rally. As his daughter said, all I wanted him to do was wake up.

Recall that 30% of polled Democrats following the assassination attempt at Butler on July 13th at 6.11 p.m., 30% of Democrats wished, and they felt comfortable saying so, they wished Thomas Matthew Crooks had not missed. They wished that he had, in fact, killed Donald J. Trump that day.
The fact that there was, in effect, a memorial service, a nine-hour memorial service, by my estimate, for Cory Comfortori this past weekend in October, that doesn't matter because, again, if you say anything positive or show any sign of support for Donald Trump in public in the current era,

of the very things that they're doing or are planning on doing. So they will say, you're dehumanizing us. So it's okay if we do it to you too. We're only being fair, is the approach that they take. Now, my perspective, and this is my very simple argument, is I support Donald J. Trump for president because I believe he's going to make things better for people. Full stop, period. End of story.
In order to disagree with me, you must put forth a noble argument in favor of your candidate, the alternative.
Generally not possible to do that because each interview that she gives, each appearance that Kamala Harris gives is somehow worse than the previous. And she sets a new world record for worst interview ever given by a political figure in this country. So there's no question of fairness. And then it becomes tribal. There's no equal sets of facts that we can compare and contrast. We had three and a half years of the disastrous Biden-Harris administration. We can do an A-B test.
With that and compare, well, how are things pre-COVID under Trump? And it was most prosperous period in American history. And not just American history, but world history.
