There was news heard around the world yesterday. If you thought Pete Hegseth was controversial, if you thought Tulsi Gabbard at DNI was controversial, oh no, you've seen nothing yet. The Attorney General pick. Before I go any further, President Trump has earned the right to do whatever he wants with the Department of Justice. Whatever he wants. They tried to lock him in prison for 700 years on fake and phony and political charges. They tormented him and tried to stop a political movement of the people
on unelected bureaucrats of Jack Smith and Merrick Garland. Remember the same Department of Justice that gave him Bob Mueller. The Department of Justice has been used as a Soviet-style attack vector against the citizen-led populist movement. There was a referendum on this topic.
Do you want major governmental reform? Do you want massive changes to the federal bureaucracy? Or do you want business as usual? There was a referendum, an up or down vote. And the people overwhelmingly voted yes. And not just the people, the battleground states, but in the popular vote as well. That is how elections work. And Donald Trump has earned the right to do whatever he wants with the Department of Justice. Whatever he wants. If he wants to troll him, he can troll him. But this is not a troll. This is very, very serious.
Donald Trump did not want to just have the same type of person like Bill Barr, like other attorneys general before. No, no, he wanted something different. He wanted a game changer. And he rolled a metaphorical congressional grenade into the Department of Justice yesterday.
A man who himself was thoroughly investigated and tried to have his life ruined by the Department of Justice, Matt Gaetz. Matt Gaetz was guilty until proven innocent. Here's how it worked. Matt Gaetz, a story came out in the New York Times back in the spring of 2021 saying that Matt Gaetz was involved in underage sex trafficking, like the worst thing you could accuse somebody of.
And then his father was blackmailed illegally and the people that were doing that ended up going to prison. And Matt Gaetz was guilty until proven innocent. And he fought and he fought. These were anonymous sources and there were no charges. And this is what the Department of Justice made Matt Gaetz and his family go through. Look, Matt Gaetz would be the first one to tell you he's lived a full life, found the love of his life and married Ginger Gaetz. Matt Gaetz is a great friend of mine, a friend of the program. But he is a victim of lawfare and he knows personally and intimately that
how vicious and unfounded these accusations can be. They can ruin your life just with a subpoena and a leak to the New York Times. They can ruin your reputation. And by the time you finally realize that the public realizes that it's fake, you are still damaged goods. And let's not forget the atrocity of the Russian collusion scam. After that, the Department of Justice deserves to be completely blown up, top to bottom. And so Donald Trump
has earned a right and he deserves, he deserves an attorney general that will fulfill that mandate. He deserves a attorney general that will let him fulfill the mandate of the American people. He does not deserve some sort of paper shuffling attorney general. He doesn't deserve some sort of business as usual.
A change agent. But my oh my, all the right people are upset. And you know what? You could not think of a more metaphorical middle finger to this lawfare system than Matt Gaetz. I get it. Cry more. But Matt Gaetz should never have gone through what he went through with the Department of Justice. Ever. And Donald Trump is doing what he said he was going to do. If you wanted milk toast, that's not what you voted for. You wanted massive government reform.
They spied on Trump, so now they get Tulsi Gabbard. They tried to lock up Trump, so now they get Matt Gaetz. They kept the border open, so now they get Tom Homan. They tried to ruin the country, and they are getting what they deserve. Matt Gaetz is a change agent. He's not going to keep the 70,000 people with guns and badges at the Department of Justice going after moms and dads at school boards, going after Catholic laymen.
at Latin mass. He's not going to have the department of justice raid political opponents like Bannon and Peter Navarro. He is going to fix the department of justice. And this is going to be a big confirmation fight. This is going to be one of the biggest ever. It is not going to be easy. Matt Gates does not have a lot of congressional allies. It's kind of why we love him. However, some people say, Oh, there's no way he can get confirmed. Don't don't don't dismiss the power that an incoming president has.
with a mandate, especially Donald Trump than the Republican Party. Do not discount that. And you know, it's really funny. Axios says, oh, 10 senators are already against Matt Gaetz. Oh, really? What are their names? Oh, anonymous. That's why. Everyone's a tough guy until it becomes a floor vote and you have to face the music. And I asked this out of a senator this morning who shall remain nameless. He said, oh, Gaetz can't get confirmed. I said, oh, really? How is it that Merrick Garland got out of committee? Let me read what he wrote.
And he says, no clue. I'm not in judiciary. But as you know, there are a couple members challenging members on it. Whoa, whoa, whoa. Hold on. So Merrick Garland, can you guys get me the whip sheet of all the people that voted for Merrick Garland? Merrick Garland received votes from lots of Republicans. Ron Johnson voted for Merrick Garland. And we love Ron Johnson.
John Cornyn voted for Merrick Garland. Merrick Garland, the craven lunatic that went after Donald Trump that we see, that bitter, angry, small man running DOJ. So if Republicans are willing to vote for Merrick Garland, why would you not vote for Matt Gaetz? So let's just go through the list. Former Republican Senator Blunt from Missouri voted for Merrick Garland.
Burr, former senator from North Carolina, voted for Merrick Garland. Shelley Moore Capito, who is in leadership from West Virginia, voted for Merrick Garland. So all of those Republicans voted for Merrick Garland that I just mentioned. If you're going to vote against Gates and you also voted against Merrick Garland, then maybe you're consistent. There is not a universe where we will accept on this program or at Turning Point Action where you will vote for Merrick Garland and you will vote no for Matt Gates. That will trigger an immediate primary challenge.

Given that our past qualified nominees did things like unleash unprecedented political warfare, maybe our qualifications aren't a good measure. Against the American people. Maybe we need a big shakeup. And by the way, Donald Trump was elected as a change agent and he is fulfilling that. He has a mandate to shake the matrix to its core. This is Democrat Congressman Jared Moskovitz telling CNN he'll be fiercely competent. Do not underestimate Matt Gaetz. If we can get him through committee, if we can get him through the proper channels, he will be a phenomenal attorney general.
He is wicked smart. He has a sky-high IQ. He has energy, capacity, love of country, knows the problems. And I'll say this right now. He is smarter than Merrick Garland. Let's play cut 405.

I don't want the New York Times. No, no, no. I want names. And if there are not names, they're terrified of President Trump and they should be. He is the most popular Republican politician leader ever. And John Cornyn is in cycle. Tom Tillis is in cycle. And President Trump, this is one he deeply and personally cares about.
I bet President Trump is going to work the phones on this one. I bet President Trump is going to call up some of these guys. No, no, no, no. Why are you against my guy? Why are you against my Matt? As he calls him. President Trump has earned the right to be able to not be worried that the Department of Justice is bugging the White House. Donald Trump has earned the right that Air Force One is not going to be filled with double agents. Donald Trump has earned the right to know that he's safe and protected and there will not be another Operation Crossfire Hurricane.
Donald Trump has earned the right to be able to know that his people are not going to be indicted. Mark Halperin is very smart. This is so beautifully put. And I had this thought earlier, and he distilled it better than I could have put it into words. Here is one factor that those who say Matt Gaetz is dead and not considering. Every Republican senator has donors, friends, staffers, constituents.
And in some cases, kin who want something from the incoming Trump administration, especially jobs. You think that the Trump White House is going to help out any senator who comes out against Gates? This is not even politics 101. It's politics one. You better believe it. Good luck getting on the committee of religious freedom. You want to be ambassador to Sweden? How about Senegal? You want to be ambassador to France? How about the Central African Republic? Or how about Laos? We're not going to play that game.
It's time for hardball Machiavellian politics. I can allow some senators. Here's the thing. Do your advised consent. Ask the questions. Grill Matt Gaetz. Do it publicly. Do it privately. But none of this preemptive, I'm going to say I'm against Matt Gaetz before you do your job as advice and consent. You get a hearing. You hear him out. You grill him. He can handle himself. Matt Gaetz is far more capable than your typical cabinet appointee. But until then, President Trump gets his cabinet because Joe Biden got his.

Well, I'm down here in Palm Beach as we all are, you know, meeting with different folks, talking about the transition. But I've lost my voice so I can officially say that Chase Scott to me. I'm trying to keep it. So I had a few days without the interviews. But yeah, man, we're all just enjoying it. You know, I tell people the first battle was winning the White House.
Right. The next battle that we have to win is going to and I think we've had tremendous success so far with a lot of these cabinet choices. But the next battle is going to be, OK, do we fulfill the mandate? Right. I know you've been talking about it. Charlie's been talking about it. Everybody's been talking about it. But now's the time. Right. We have to win this battle and we're going to have a bunch of them. You know, this is not going to be a walk in the park. This is going to be difficult. But I tell people we can't be out to lunch just because we won the election.
And so to all the activists out there, to everybody that thinks, you know, we can just celebrate and go home, this is the time to shine.
We have to hold – and by the way, I'm talking about Republicans. We have to hold a lot of these Republicans accountable to make sure that what we're doing actually fulfills the mandate that the American people sent Trump back to office, took over the Senate, continued to keep the House, and now we need those policies that they are mandating that we bring to the American people.
Yeah, I completely agree, Cliff. And speaking of Republicans, this is John Cornyn cut for 14. He's saying he wants to review the ethics report that was coming out of the House before Matt Gaetz decided he was going to resign effective immediately for 14.
We'll be talking about recess. On the issue of vetting, though, how critical is it to have access to what the House Ethics Committee has found in their investigation? I think there should not be any limitation on the Senate Judiciary Committee's investigation, including whatever the House Ethics Committee has generated. So you want to see it? Absolutely.
Absolutely. He wants to see it, Cliff. So this is a guy, Cornyn, who is the senator from a state that went 14 points for Trump. Absolutely sweeping. The polls were predicting three or four points in Texas for Trump. It goes 14. This guy's in cycle. Cliff, I do want to get to some updates in PA, but just for a moment, respond to that.
Well, let me start off by saying this. I was quiet about this during the cycle, but, you know, I'm a lifelong Pennsylvania resident. My whole family is there. I spent 22 years of my life in state. I live in Matt Gaetz's district, right? I tell people that, you know, he is by far, it's an honor to have somebody like him represent me and my family because, you know, he's a fighter, right? And to have him now appointed as AG, of course the swamp's going to push back. Right?
Right. But when you know, when you have Republicans like John Cornyn, who needs Democrats?
Right. So I totally agree that this is going to be a knockdown drag out fight. Yes, they should ask Matt the tough questions, but he's ready for them. Right. He's an honest broker. He represents we the people. And look, the reason we love him is he doesn't have a lot of friends in Washington, D.C. But the reason I think that this Trump appointment of Matt Gaetz as attorney general is so smart is because we're going to know right out of the chute.
Who's ready to fight for the America First movement and who's ready to stand on the side of the swamp? That's what's the most important about this. John Thune has a great opportunity here. OK, I'm going to give him a chance. OK, I've looked at his voting record. You know, he's been on the wrong side of a bunch of issues, but he's been on the right side on a couple of them. So he's got a fresh slate now.
Which direction does he take it? And if we, A, do the recess appointment, that'll show us right away, you know, that Thune's ready, at least for this first couple battles, to be on our side. And if it goes to a floor vote, I mean, we're going to know. We're going to have those names. And I'm going to stand here with Charlie, with you, and I'm going to say that I'm going to put the full force of my entire grassroots operation
behind primarying any Republican that stands in the way of the America First movement. The time for excuses is over.
And so John Cornyn is not going to be the only one. There's going to be others. But if these folks don't get in line, if they block Donald Trump and his agenda, we will go to war and we will take them out politically. We will be on the ground in their states. We will be turning out voters to primary them out of office. You have my word right here on The Charlie Kirk Show that we will stand there with you guys. We will put all of our time, energy, resources, everything we've got into primarying any of these Republicans who are weak,
and attempt to block Donald Trump. Well, Cliff, on that note, we floated this, that we were willing to go to South Dakota, we're willing to go to Texas, and I can't even tell you how many people in the grassroots came out
And we're basically like, hey, we have this venue. We've got these insiders, the grassroots. We've been looking for help and support. These guys have to know that this is not business as usual. This is not you just you got an R next to your name. You get through the primary if you're an incumbent and then you just you just keep doing it over, you know, rinse, rinse.
uh, wash repeat. This is not going to be the new Republican party, uh, that we see now, Cliff, I want to, but, but I'll, I'll finish with what, with what you say. I want to underscore that we're going to give these guys a chance that, you know, Senator Thune, if you want to support the mandate that Trump won, not you, that Trump won, not you. If you want to support that mandate and give his nominees a chance because the American people gave president Trump a chance, uh,
It's great. We're going to support you. If we are pleasantly surprised, we will support you. You will become a folk hero. But if you stand for the business as usual, it's not going well for you. It will not. I want to pivot here, Cliff, because you are Mr. PA. I know you're down in South Florida. I'm heading out there after the show, Cliff, so I expect to see you promptly as I land.
So here. So what's so P.A. Bucks County, we're getting all these you know, we got this McCormick thing. Mark Elias is there. He's trying to challenge. I looked at New York Times before you came on. They still don't have the Senate race called. You know, it's this little collusion of the far left. What's going on in P.A.? What's going on in Bucks? Break it all down for us one by one.
Yeah, this is why when we launched the P.A. chase, I told people, I said, yes, we want to increase Trump's share of mail-in votes to 33%. But the reason I said that was not just because I thought we could win with 33% of the mail-ins, but because I knew that if we won by less than the amount of provisional ballots, we would be going through right now what Dave McCormick is going through, and they would drag this thing out for months.
Okay, and obviously I'm very proud to say that we hit 34.5% of Trump getting those mail-in votes versus Harris. I mean, that's up, you got 22% back in 2020 versus Biden. So 22 to 34.5. I'm very proud of that. Got to give turning point action, early vote action, America first works, the Trump campaign, everybody gets credit, right? It was a grand just finale of people coming in to get us where we needed to be. But here's where we're at with McCormick, okay?
We're up by roughly, let's say, 30,000 votes, and there's about 100,000 provisionals in the state. Okay, now provisionals, people have to understand what a provisional ballot is.
In the old days, you'd think of a provisional as, well, they didn't fill in the circle fully or they kind of marked both candidates. And, you know, or somebody shows up and they're not registered to vote there. They're registered in a different precinct. So they put all these in a provisional pile. And typically they don't look at them because they're not needed unless the election is razor thin like it is now.
But what's happened is because of the mail-in voting, it causes a lot more issues that then get deemed provisional. Let me explain what those provisional issues would be. One, they don't sign the envelope on the provisional mail-in ballot. Two, they don't date it correctly. And three, they don't use the proper secrecy sleeve for the envelope.
And so what happens there is that creates all of these different issues that then get put into a separate pile batch by batch, county by county that are considered provisional. And then, yes, you have a couple of those like the old days where you have irregularities and somebody that came in and the ballot had some sort of issue. OK, what's happened now is in Bucks County specifically.
They are going against the Supreme Court's ruling that if they're not signed or they're not dated correctly, they're going to count them anyway. And this is what I tell people. These boards of elections and these judges, they're timid. They're scared. The left fights, and they always capitulate. And that's what's happening in Bucks.
So right now, McCormick's team has filed a lawsuit to hold them accountable and say, no, hold on a second. The Supreme Court of Pennsylvania has ruled that you cannot count a ballot. It is not legal if it's not dated correctly.
And so these are the basic rules. And when people talk about legal votes, this is the perfect example. There are a set of rules you have to follow for your vote to be legal. They didn't follow the rules. And now the Democrats are using pressure with Mark Elias. And by the way, I wish we had people that fought with his tenacity. You know, good for them. I will give Whatley and Laura Trump so much credit because we're finally on par with them. But of course, they're fighters. They're going to try to use the courts to win this.
So this thing's going to drag out. The automatic recount has been triggered because it's less than 0.5% of a race. And Casey had the option to say, no, I don't want to do it. He didn't say that. We're moving forward with the recount. But this is going to take court case by court case, county by county, to decide which of these ballots will count. And here's the good news.
Even if all of the provisionals count, all 100,000, we still feel like we are in a position where he does not have the votes. There are not enough votes out there for Bob Casey. But Democrats want to put Dave McCormick through this pain, and they are the type of people I don't think they're going to relent. Bob Casey should resign or, excuse me, concede right now.
We could move on. We could get to work for the American people within the U.S. Senate. I don't think he's going to do it. And unfortunately, that's the Democrat playbook. All right. So Mark Elias, real quick, boil it down 30 seconds for us, Cliff. What's his role in this and how is the RNC countering him?
Yeah, so what he's doing right now is he's going out to counties that they think are going to be favorable for Bob Casey, and he is using every legal trick in the book to count these votes. Because remember, listen, when you're down, you want as many more potential votes as possible, right? You're not guaranteed to win in some of these counties, but you need more votes anyway, so why not go for it?
So Elias is going county by county in Pennsylvania. He is working to pressure or file lawsuits to pressure these boards of elections to count all these provisionals. And so that is his battle right now. How many more votes can he get to count? And their hope is the more votes they count, the more likely it is they can make up for.

How do they stay apprised of what you're doing? Yeah, sure. Folks can follow me on X at Maloney, M-A-L-O-N-E-Y. Look, the Pennsylvania chase was a smashing success. And like I said earlier, we've got all of our partners involved.
including Turning Point Action to thank for that. What I'm doing right now is pretty much over the next 30 to 60 days, we're going to be compiling our formal plan to relaunch the Pennsylvania Chase January 1 of 2025. Let me say that again because I think people miss this. Okay, I said this from the start. I want to match the Democrats' tactics. That's what I want to do. I want to fight fire with fire.
We had a ton of success chasing ballots during the presidential race and all the down ballot success that we had. But, you know, Scott Pressler announced and I'm right there with the presser says, no, we're going to be back out registering. Why? Because Democrats are doing it.
Yeah. So, you know, everybody thinks about 26 and 28. And at the end of the day, it's like I want to match the Democrats line item for line item or what they do. We did that during the presidential race with the PHAs. I mean, Scott Pressler registered more people than I think existed on the target list, you know, for Republicans in the past. And we have to keep matching them.
So Scott's going to continue to register like a wild man that he is that gets it done. Turning Point Action is going to continue to do what they're doing in all the target states, building up. I mean, heck, if I could get Charlie Kirk to do an event at each of the target counties in PA, we'd probably be a permanent red state, right? But the idea that we can wait until 2026, we need to stop thinking about things like this. We need permanent infrastructure.
Okay, you're going to hear me use those words a lot. Permanent infrastructure. Whatever the Democrats are doing, we need to match it. They're out there 365 days a year. Okay, they were preparing for the 2024 election in 2021, right after they won Pennsylvania.
So we can't just show up every four years. We can't just show up every two years. So the next 30 to 60 days, yes, I'm going to put a plan together that really has a budget and we're going to have exactly the operations that we want or that we need. And January 1 of 2025, we're going to launch it. We have three Supreme Court races in Pennsylvania in 2025. Okay, there is no off year in Pennsylvania. And so folks can follow me on X at Maloney.com.
They can email me directly, cliff at pachase.com. We're going to need all hands on deck. And we are just simply doing one thing, fighting fire with fire and matching the Democrats' tactics. If we do that, I feel very confident that 2026 will not be some setback year and that 2028 will be an even larger victory when we have in place permanent infrastructure.
So how does this work in PA? You've got three PA Supreme Court justices up for retention in November 2025. So then if they vote no to retention, then there's special elections in 2027? Yeah, it's a little confusing. But yes, the other thing I will share with you guys that are not that familiar with Pennsylvania is our mail-in ballot requests, they reset every year.
Okay, so when you go to request your mail-in ballot, right, in some states, everybody gets sent a ballot. Okay, every registered voter, the ballots go out when they go out and everybody gets them. In Pennsylvania, the reason we got crushed in 2020 is because Democrats understood this and they worked it to get people to request the ballot. If you got a ballot at your door, you were like three to four times more likely to vote when you're just looking at those low propensity voters that we all targeted. Right?
So in 2025, it resets. Everybody has to request a ballot again, and we're trying to create that culture, that behavior of them being confident in requesting it and then dropping it off at their county office.
So, yes, we'll have retention elections to vote no. We'll have other local municipalities, school board races. But there are going to be races all across Pennsylvania. But the most important thing here is that it resets. It resets January 1. So that's what we have to do is go out and chase applications or requests for people to get a mail-in ballot.
All right, so last question here. One minute, Cliff. Explain the role of the RNC in Pennsylvania. Whatley, Lara, Trump, are they on top of this lawfare, Mark Elias attempt to rob another Senate seat? Absolute rock stars. Okay, I'm not paid to say that. I have no incentive to say that. The RNC, between 2020 and 2024, when you have LaCivita, Blair, Wiles, the whole Whatley and Trump, I mean everybody,
They understood that we had to triple down on lawfare. We had to triple down on making sure that we're protected and we have election integrity. They've been three steps ahead on any issue we've had in Pennsylvania. And look, I'm grateful because I don't have the bandwidth, right? Scott Pressler doesn't have the bandwidth. We have the things that we were assigned to do. We went out and did our job.
But none of it, none of it would have been worth it if we didn't have a legal team behind us backing up everything that we were doing to make sure that this was a fair election. So I feel very confident and I'm proud to say the RNC has just really stepped up and been there when the country needed them most. That's fantastic news.
We don't have to litigate it now, but the change, the RNC, the timing of it turned out to be critically important to the outcome of this election. So Cliff Maloney, P.A. Chase, keep doing your work.
