Pre-debate analysis starting at 8 p.m. tonight and also all of the breakdown of what is going to be the most consequential debate in modern American history. Now, it could end up being a very boring debate. Honestly, boring is a win for Donald Trump. Boring would be a triumph. Now, there are two ways of governing. You can govern using force or you can govern using speech.

The last three and a half years, we have been living under a pseudo-tyranny that uses force, not speech. When you use speech, you try to find a moderate ground. When you use speech, you try to find where you agree to disagree. When you use speech, you say, you know, I might not see the world the way you do, but I'm not going to lock you up in federal prison for 700 years. The founding fathers, when they wrote the U.S. Constitution,

which was the greatest and is the greatest political document ever written. It was an emphasis on what Aristotle would say is we are the speaking beings. What makes us different than dogs and horses is we are able to make sense of the natural world by using our speech, to use reason. The spoken word is an exhibit and is an ability for us to show that we have reason and animals do not.

More than just feeling pain or pleasure, we are able to differentiate between good and evil. Speech is what built the West. Force is what is destroying it. Joe Biden and the regime knows that what they have done is deeply unpopular. They know that their set of policies and the destruction on the country is not pulling well with people at all. If you live in Kennebunkport or Sun Valley, where I just was, or parts of Aspen,

and you are on the center left, you think that things are great. You're richer than ever before. Your oligarchy is protected like never before. Truth is a threat to the regime. Free speech is a threat to the regime. With free speech, you can transmit truth. The Biden regime has suppressed our freedom of speech and suppressed our access to truth. I do not think people understand the profundity of what is about to happen tonight. Tonight is the first opportunity since 2020

in an unscripted way that Joe Biden is on an island. It is the first opportunity where he does not have his handlers. Now he does have his CNN babysitters there. He's got Jake Tapper and Dana Bash, but this is the first chance that the alleged leader of the free world, the commander in chief,

has to answer for what he has done to this country. He has to answer as to why he's allowed the foreign invasion on our southern border, how he has deteriorated the US dollar, how he has got us closer and closer to World War III by funding this bloody proxy war of Ukraine versus Russia. Tonight is the first opportunity at accountability. You see, the Democrats do not want to do this.

Joe Biden would not be doing a summer debate. I've been doing this radio program now for almost four years. It'll be four years in October. Summers are usually the hardest to find stories. We're always, you know, oh, can we have an expert on this? Or can we have an author and, you know, trying to promote books? Summers, they call it the slow news summers. People take time off and

Not this summer. This summer is unlike any other. We have Supreme Court decisions looming. We have sentencing to prison looming. We have a presidential debate. Understand that the framework of what is about to happen tonight is an act of desperation by Joe Biden. Joe Biden would not be showing up and demanding a summer debate if he felt like he was winning in the polls. He is seeing...

in his own internal numbers, that if the election was held today and that election was free and fair, he would fall short. This is a move of desperation. And they are hoping that they will able to be able to get Trump off of his game, that Trump will be able to play into the stereotypes that they have been fitting on TV. They hope that the race is going to tighten tonight. They are looking for a great campaign reset.

They are hoping that with a push of a button, they will reset and resurrect Joe Biden back into the margin of error, which we know is the margin of steel within these states. You see, Joe Biden falling behind Donald Trump so significantly is why we are now going to have this summertime debate.

And it is so fascinating because if they had their way, they would continue to use force to terrorize the country, not speech. They would continue to use handcuffs and leg irons and subpoenas and raiding of homes, not debate. This is one of the last opportunities that we will ever have tonight.

to be able to put the current ruling class regime, the expert class, the managerial class on trial. And that is how Donald Trump should view his role tonight. Two things, defend your record, not just defend it, brag on your record and put the regime on trial. Make it bigger than Joe Biden. Don't just say it's you, Joe, it's your team, it's your policies.

The other buried lead of this is that Operation Mockingbird has been losing its influence. Alternative media has put Joe Biden and the regime on defense. I want to play some pieces of tape here of previous debates of Trump v. Hillary Clinton. Let's play Cut 79. It's just awfully good that someone with the temperament of Donald Trump is not in charge of the law in our country. Because you'd be in jail. Secretary Clinton...

You see, I love the fact that there was an audience there. That was one of the most legendary moments in debate history. Remember, there are no fans tonight. Well, that's not true. Joe Biden has two fans in the audience, the moderators. It turns out we know Trump will not have a live in-person audience to feed off of. Even reporters will be housed in a building across the street.

Trump will be alone in the studio with the only people to feed off of are the CNN moderators, who, of course, will be cold and hostile towards him. This creates a very sterile academic environment for the first presidential debate, which favors a lawyer legislature like Biden, who is more experienced at this kind of dispassionate debating. Clearly, CNN designed it in this way to give the edge to the Democrat candidate. So you have to understand the framework, the debate details favor Joe Biden in this regard.

You have to give credit for Donald Trump. He is playing offense. He's unafraid to take the fight to Joe Biden. He is not playing prevent defense. This is not the, hey, go three safeties high and just allow the team to get back into it. Trump is a fighter. As Trump says, he accepted rules rigged against him because Trump believes that his ethos of this campaign is that the rules are rigged against the American people. And that is what he should say tonight.

Ladies and gentlemen, the rules tonight are rigged against me at CNN, the same way the rules have been rigged against you the last three and a half years. Now I want to give you a sense of what it will look like for viewers at home if a candidate whose microphone is off interrupts a candidate whose microphone is on. So I'm standing at one podium, and I'll ask Phil to come in and take the other podium. And so let's say I'm answering a question. My light is green, and I'm speaking. Phil's microphone is off, and his green lights are not illuminated. He's going to interrupt me as I'm speaking, and this is what it will sound like. My volume remains constant, while Phil's interruption can be difficult to understand.

Let's try the opposite. My microphone is now on. Victor's microphone is off. And he's going to interrupt me. My volume remains constant, while Victor's interruption can be difficult to understand. Now, CNN's production team has shared this demonstration with the campaigns earlier today, and we're sharing it with you, our viewers, so everyone fully understands how tomorrow night will work. Now, we should note, by agreeing to participate in this debate, both campaigns and candidates have also agreed to abide by these rules.

The CNN presidential debate airs live at 9 p.m. Eastern. So the first question I have is if Donald Trump is finishing a point and he is a second over the minute, are they just going to cut his mic? And Donald Trump has to now keep his eye on the light of whether or not they keep they cut his mic and he can't come across as too upset because of that.

So, for example, if he's making a good point, all these guys go over there a lot of time. They go over there a lot of time. And if they go over by five seconds, they say, OK, Mr. Trump, thank you very much. Let's get Mr. Biden. Instead, are they just going to cut the mic? You see, what we have in front of us for Donald Trump is far more upside than Joe Biden. Joe Biden's campaign is in survival mode right now.

This here is a bailout rescue operation for Joe Biden. And you have to give Donald Trump enormous amounts of credit. The stones and the cojones to go into a CNN presidential debate in the summer when you are the front runner, that defies all conventional presidential wisdom and logic.

And so if President Trump ties against Joe Biden, and quite honestly, President Trump doesn't have like any one line moments or any you'll be in jail. If people say, well, that debate was kind of less than I expected. That is a win for Donald Trump. Said differently in a football analogy. No need to stretch the ball out and to throw 50 or 25 or 30 yard passes. Just run the ball. We're hearing that Joe Biden is already rehearsing one liners.

Now he could butcher them terribly. Now I want to play this piece of tape here. This here is the entire debate. It is an extraordinary video. It is one of the most powerful TikToks I've seen. This is a non-political guy on TikTok. This is what Donald Trump needs to lean in on this. And he should actually use this example, by the way.

He goes to his Walmart app. It's a brilliant idea. And by the way, this should be a movement like writing the no tax on tips thing. He went on his Walmart app and he looked at two years ago, exactly to the date, June of 2022, of groceries that he would purchase that would feed him for one month. On the app, you can press a button that says reorder all because it remembers your orders even two years later. You will see for yourself how expensive it now is to feed yourself

In America, this is one of the most powerful clips from a non-political TikToker. Play cut 85. I feel like I'll go be sick. I just like look through my Walmart history and I found this like Walmart order from two years ago for the whole month worth of groceries. 45 items cost $126. A whole month of groceries just for me, basically.

But I did notice this reorder all button and I wanted to see how much it would cost now. Now, this order of 45 items for one month would have cost $414. That is four times more. How the f- How?

Now, I don't know how you voted, my friend, but you voted for Joe Biden. You voted for that. We told you it was going to happen. We made the accurate prediction. When you spend $6 trillion a year and trillions of dollars that we do not have and flood the system with more dollar bills than value, food is getting really expensive. Let me repeat that. Groceries for this young individual cost $126 for one month.

Two years ago. Now it is $414. So unless his income went up by nearly four times, a 400% increase in groceries. He's saying, oh, why? It's because Democrats are in control of our country. That is why. Because Joe Biden and deficit spending is driving this.

Joining us now is Mike Davis, who is outside of the United States Supreme Court, maybe waiting for, are they going to drop the decision on the day of the debate?

It would be gutsy. Mike Davis, how are we doing? What are we expecting soon from the Supreme Court? The Supreme Court just announced another opinion day on Monday, which is unusual that they're going into July. It's been several years since they've done that. I think going back to 2021 that they haven't gotten their opinions out by the end of June. But there are still quite a few cases that the Supreme Court announced

must decide, including the crucial case of whether the president of the United States, any president of the United States, is immune from criminal prosecution for his official acts, not his personal acts, his official acts. And if the Supreme Court does not get this right, you're going to have presidents indicting their predecessors to

For what they did as the president of the United States, you're going to destroy the country in the process. So I think the Supreme Court understands that and they're going to rule in Trump's favor in that case. You also have the Fisher case, the January 6th case.

that the Supreme Court must decide where the Biden Justice Department has contorted a post-in-run federal obstruction of justice statute intended to go after corporate fraud that Biden and Garland and Matthew Graves and Jack Smith have used to go after Trump.

and his supporters on January 6th, they have been persecuted. The Supreme Court appears to be on the cusp of reversing those criminal convictions under this post-Enron obstruction of justice statute. Just today, the Supreme Court issued a critically important ruling on the separation of powers and on the administrative state's

the chief justice in a six to three opinion issued, uh,

said that the Securities and Exchange Commission can't have employees, administrative law judges, as they say, decide these cases as judges. That is something that federal judges must do. And these people who have matters, when they have enforcement matters, it has to be through judges and juries, not through unelected bureaucrats and the securities authorities.

and Exchange Commission. That is going to be a powerful opinion because there are a lot of three-letter agencies in Washington, D.C. who think they're independent, even though they're part of the executive branch. They don't think they report to the President of the United States, and then they have

lawmaking authority. They have the power to enforce their own laws and they have the power to interpret and adjudicate their own laws. That's the very definition of tyranny. And the Supreme Court is starting to roll back this decades long unconstitutional process in the federal government. So, Mike, help me understand this. So people are saying that John Roberts is going to be the author of the Trump immunity case. Is that a bad sign?

It seems like he would be the author, but it seems like that would actually be a good sign because that means that the chief justice is in the camp with the other conservatives. I think the opinion could be five or six points.

In the majority, you might have Justice Amy Barrett writing a separate opinion, maybe a concurring opinion, and then the three liberal justices writing a scathing dissent. But I would say this to those three liberal justices.

If Biden can get away with indicting Trump for his official acts, like, for example, contemplating firing the acting attorney general after the election, does that mean the Trump 47 Justice Department can prosecute Trump?

President Obama for his extrajudicial drone strike on two American citizens, including a minor. Does that mean President Trump's Justice Department can prosecute President Biden for his illegal mass parole of millions?

of illegal immigrants into this country and the resulting rapes, kidnappings, murders, and other violent crimes. Does that mean the Trump 47 Justice Department can prosecute George W. Bush for lying about weapons of mass destruction and the resulting rapes

war and deaths of millions of people. Do they really want to go down this path? I don't think so. And I think the Supreme Court understands if you don't find that presidents are immune from criminal prosecution for their official acts like they've been immune for the last 40 years from civil prosecution, you're going to destroy the presidency and therefore you're going to destroy the country. And I think that very much resonates with the Chief Justice and Justice Kavanaugh.

So the left will lose their mind over this. How much of Jack Smith's case would then be dismissed based on presidential immunity? Not all of it. The documents case in particular. Help me understand. Well, so it would be whatever President Trump did in his official capacity as the president of the United States. And this would affect...

All of these criminal prosecutions against Trump, it doesn't mean the whole case goes away. It just means that these cases would get sent back in the D.C. January 6th case. It would get sent back to D.C. Obama judge Tanya Shutkin, who stupidly before just blanketly held that the president could be prosecuted for his official acts.

and then three, two partisan Democrats on the D.C. Circuit and a washed-up Republican went along with that. They're all going to get reversed, as they should. D.C. Obama Judge Tanya Shutkin is going to have to hold an evidentiary hearing, a mini trial, to figure out what did Jack Smith allege that President Trump did in his official capacity? Like, for example, contemplating firing the acting attorney general. A private citizen can't do that, only the president can.

can do that versus what did he do in his personal capacity where he could be subject to criminal prosecution. And then that decision, however she decides, if she screws it up again because she's a moron, then it gets appealed again to the D.C. circuits and they have to decide. And then that gets appealed again to the Supreme Court. So the bottom line is, it doesn't look like this January 6th case is

in D.C. who the Democrats thought that was their silver bullet to go after Trump and take him out for the non-crime of objecting to a presidential election, which is allowed by the Electoral Count Act of 1887 and the First Amendment. But the Democrats thought they would have this Biden partisan Jack Smith and this Obama partisan Tanya Shutkin with Trump in trial right now and then heading to prison. Instead, Trump's on the campaign trail and he's heading back to the White House.

Yeah, and so, Mike, I certainly hope so. Help me understand on this separation of powers issue. This is a big one. What would that then mean for a second Trump term as far as giving the ability to control the administrative state? And spend a little bit of time on this. Spend a couple minutes, please, Mike. The administrative state is a post-constitutional and largely unconstitutional legal creation. Please explain to our audience.

Yes. So the Constitution is a loan agreement between we, the people, and our governments, the federal, state, and tribal governments. We escaped from England. We escaped from the crown where power comes from God to the king and then is looted.

lent to the subjects through decrees like the Magna Carta. In the United States, it's the opposite. Power comes from God to us as the sovereign people instead of a sovereign crown, and we lend power to governments. That is a radically different concept from England and Europe and the rest of the world, especially at the time. And so if we did not lend the federal government power

powers specifically enumerated in the constitution. It belongs to the states and we, the people, the 10th circuit confirms that we were supposed to give the federal government very limited specific and divided powers. So Congress has legislative power. The president has the power to execute and the judiciary has the power to decide cases and country controversies, the judicial power. What has happened is,

with the administrative state is the federal government has assumed all power from the states and from the people, power, they're not supposed to have that started after FDR. And then we've created these administrative agencies that are part of the executive branch, but they pretend like they are independent of the president

of the United States. It used to be you couldn't fire them, right? And so then what happened is these agencies, not only do they grab all power that the federal government doesn't have, they grab judicial power, they grab legislative power, and then they grab the president's executive power. And so over the next 20 years, what you're going to see are these constitutional changes

The constitutionalist judges, thanks to President Trump, who transformed the Supreme Court and the lower federal courts where they're going to start rolling back the federal government. They're going to start rolling back this federal power, and they're especially going to take away the power from these agencies that think that they're independent. We saw that with a major decision today yesterday.

This July, as we celebrate the birth of our nation, it's important to reflect on the freedoms our forefathers fought for. But today, these freedoms are under attack. et cetera, et cetera. How should Donald Trump respond? It's so simple. President Trump should say, okay, Joe, tell me what is a woman. That is how he should respond. I can tell you it works. They can't answer that question. Katanji Brown Jackson couldn't answer that question. The debate is tonight. It is the CNN presidential debate. It will be a simulcast. It's a very interesting media story here that is not being covered, which is

CNN was going to have exclusive rights to this, and now they're blasting it out to everybody. They're allowing it to be simulcasted. It's going to have huge numbers on Rumble. Rumble is just going to be amazing. If they ask him about January 6th, here's how President Trump should respond. January 6th is an important day, and it's 14 days before we take back the White House and fix the mess that you, Joe Biden, have inflicted on this country. That's what he should say.

Very simple. Move on. That is backward-facing nonsense, total BS. We will see how he handles these things. I believe he's going to do very well. Focusing on migrant crime is incredibly important. Oh, just so you know, another story out today. Another illegal has raped a woman in downtown New York.

And asking the question, Joe Biden, how many illegals have crossed the southern border under your presidency? Do you have any range? How many are currently crossing? What is the number, Joe Biden? How many terrorists are in the American homeland that your own government acknowledges they have no idea where they are? Are women safe in this country, Joe Biden? Do you know where the women, how many rapes are happening every single day, Joe Biden?

And this is the tape that must be played and played and played over and over again. This is cut 23, mother of 12-year-old Houston girl who was strangled by Biden's boys. The two Venezuelans speak out. I'm angry that they took advantage of her. She was so young. But this is who Joe Biden has invited into the country. Play cut 23. I'm like angry that they just, they took advantage of her. She's so young. She's swell.

He took my baby away. Now I get to let a brother know his sister never coming home. Open borders are a tragedy on the society. Another young innocent girl raped by an illegal in New York last night. Turkish national, Secur Akan, entered our country illegally last year. No background check, no idea who was doing. Biden just let him into the country. Arrested for allegedly forcing a teen girl into his car with a metal pipe and raping her.

This reportedly happened in May and the police decided not to notify the public because they believe he didn't pose a threat. He came to our country illegally last year and was released by border patrol. As the illegals who are coming into the country, they warn us that the other illegals are not so good people. This is Bill Malusian. This tape needs to be repeated. Turkish man who says there are some really bad guys coming to the border. Maybe he was with the rapist as he passed the border. Play cut 56. Did you have to pay a cartel?

Yes. How much? Around 10,000. 10,000? Yes. In fact, the American people is right, completely true. Who come into this country, they don't know. Okay, I'm good, but how if they're not good? How they have to kill a psychopath else? No guarantee of that. Why, like, no security check, no background check. No security check, no background check. You're worrying about who's crossing the border? Yes, yes. Of course, maybe because I'm like, people are not normal. People are not normal.

President Trump should commit these three names to memory. Jocelyn Nungare, Lakin Riley, and Rachel Morin. He should have asked Joe Biden, who are these people? Joe Biden, who's Rachel Morin? Oh, the mother of five that was hunted down in a hike in Maryland, raped and murdered by one of your boys that you led into the country. You see, Joe Biden's gonna try to spin on the border. Well, border crossings are down 40% and Trump has to call that absolute BS. Mr. President, Joe Biden,

I called their family. Did you? Did you call the Lake and Riley family? Did you call the Rachel Morin family? Joe Biden, we spent an entire summer after George Floyd died, burning the entire country that you were responsible for and you were supportive of, I should say. Why are you so indifferent when American citizens are being killed by foreigners that you let into the country?

Immigration and the economy are the two biggest issues going into this debate. I certainly hope that it will be given a opportunity and a platform to be discussed.
